Saw online that they are sending my RFE. And yes, I don't have NOA2 yet. May 4th is my NOA1 date.

What service center are you?

I think we might have people receiving RFEs either tomorrow or monday, but definitely next week.

As the only people who got an email stating that RFE is on the way never got their NOA2, we need to wait and make sure this is actually about IMBRA.. I´m pretty sure it is, but at this time I don´t question anything...

good news everyone!!

I just received an email saying that the RFE is on the way to me...yeah!!! Our case was put into the system on Apr 24. So maybe VSC is sending out the RFEs to everyone regardless the NOA1 receipt date.

Hi all! I am in the airport in Tokyo waiting for my next airplane. Luz and I had a GREAT time!!

I got the email on the 14th saying my case was recieved and they have been touching me every day!!! One on the 14, 15, 16 and again today! I hope this means that I will get my RFE soon. It would be so good to have it waiting for me when I get home.

Posted this in part to another thread but wanted to post it here as well.

Processing of petitions IMHO will not change from the service centers regular system of processing.

Any petitions submitted on or after March 6 will receive an RFE in order for the originally submitted petitions to be compliant with the IMBRA. This is going to vary between the service centers as VSC despite all the recalled petitions and their normal work load (now including backlog) have always been notably more efficient. What is happening right now is not a surprise. The normal processing of each petition will not then occur until they are up to processing petitions with the date of receipt on each petition.

Presently

CSC is showing as processing petitions with a receipt date of Feb 3 (obviously still processing cases pre IMBRA)

VSC is showing as processing petitions with a receipt date of March 6

So therefore eg a petition with a receipt date of even say May 29 will be sent an RFE so that the petition is compliant with the IMBRA but that petition will not continue with processing until they are processing petitions with a receipt date of May 29. All will be as usual. RFE's will be sent out in mass but how your petition is processed will still be dependant on the receipt date not on when you get and return the RFE.

As the recalled petitions (primarily from VSC) have already been approved they will be sent an RFE just like any other to bring the originally submitted petition up to compliance but they will not IMO have to wait for the processing date to reach their original receipt date as in all other aspects they have already been processed. Except those that will need further processing due to criminal history and/or filing of multiple petitions. Petitions will then be forwarded again to Consulates via NVC.

It's great to see that things are moving again, even if its not as fast as you all would hope for.

What cheerful tidings to start the morning, Lorelle.

What has CSC been doing, I ask myself. They have had at least six weeks of this "stoppage" to catch up and organize themselves -- make preparations for this new review. But you say they are still stuck back in the pre-IMBRA days of Feb 3rd!! This entire Nebraska/CSC transfer stuff on top of all else has me really bummed.

They are supposed to be gearing up big time to get these out next week. But that doesn't mean many of us will see anything for a few weeks as they process all of these things. As far as I know nothing is going in any specific order anymore they are just trying to process everything as fast as possible to get through this mess.

As a matter of fact, oficialy I haven't recieved any notification that I have been effected at all by this either. However, due to the time when my NOA1 was, we fall well passed the march 6th "Deadline", so it is disconcerting to say the least when no one is hearing anything, AND the philippines embassy operator still thinks it's at the embassy. My greatest fear is they lose it and I have to start all over again.

Is there a way to get them to physicaly confirm it's still there rather than checking an easily flawed catalog?

Also, because some people have gotten NOA2s from before March from CSC, so I don't think Feb 3d is an accurate date.

No one aside from people who were unfortunate enough to have their petitions recalled from the consulate have received any kind of official communication from USCIS indicating that we are affected by this. They seem to have taken the view from day one that not telling us anything is the way to go.

It may be that the majority of the applicants, they assume, are not DIY'ers like we are and aren't at this message board (or a few other competing ones) so they may think that lack of communication until an RFE arrives will lead the petitioner to believe this is all just a normal part of the process. Business as usuall. Very CIA/NSA skunkworks of them.

Honestly I would not be surprised if this is the case. The American Government plays on our ignorance all the time like this. Sneaking in laws, and policy changes without our true awareness. IMBRA is a sign of the times. But it's just one of many things that our government has been doing lately (last 12 years) across the board. Corporations own it now. So these slight handed new laws and policies will be more and more prevalent as the years go on.

I read in other threads about people from CSC getting an email saying their RFE has been sent.

Same thing with someone with a recalled petition.

They are probably just sending it to everyone.

There´s no way to predict when they will touch a particular case.

We have people from Vermont with receipt dates from March, April and May saying their RFEs are on their way.

I just want to know if they work on saturdays, even if they don´t take phone calls.

My status doesn´t change since my case was approved back in April.

I never received communication from USCIS or anybody. The Moscow Embassy called Diana in late May to tell her that her interview date had been cancelled, and that is the grand total of the official communications that have been received by both of us!!!

Also, when checking my status online on the USCIS webpage it is still saying the same damned thing it was saying in late March: This case has been approved....
