Other then the phone call from the Moscow Embassy to tell us our application was being returned and our interview cancelled we haven't heard anything from USCIS. Additionally our case hasn't been touched since 05/01/06. Should we be worried USCIS hasn't recieved the returned application? Any suggestions on what we should do?

03/25/06 129F Application Sent

04/06/06 NOA1

04/12/06 NOA2 Approval

05/06/06 Interview schduled for 06/29/06

05/23/06 Call from Moscow Embassy - Application returned and interview cancelled

I don´t know what´s going on.

Forgive me if I think we live in a fair world.

I have my NOA2, my p.3, my p.4, my interview date and I think they should update my status. All of us we recalled petitions should be treated with respect because people made a mistake with our case.

My lawyer doesn´t say anything about it and USCIS does not seem to care.

It could take another month, which it would be fine if I was told about it, so come on.. all I´m asking for is an update.

I check up on this thread from time to time to see how you all are doing.

I have to say - for the most part you are a resourceful and efficient group! And it tickles me to see people HAPPY to be getting RFE's!!! LOL!!! For the length of my membership here (Dec 04) I've mostly just seen upset over RFE's. But we all know it's progress for you guys, and I'm sooooooooooooooooo glad to see this!

Am I reading correctly - is the new I-129F approved and up and running?

All it said was that the application was approved. When I talked to a representative she said she couldn't tell me if it was recieved or not. She admitted they couldn't tell me whether it was lost in the mail or ever even sent by the embassy. These people are horrible!!!!!

ok, here is my spin on the situation.....could it be the reason why Vermont is sending out the RFE's(or so it seems) to the later petitioners (not the recalled ones) is because they are already sitting on theirs desks, and not in a pile in a separate room somewhere? Perhaps also this is the reason why the electronic system shows them, and doesn't show us because we have been approved already? Which does not go to show that ours are not being worked on either....just maybe its not as easy to track??? Perhaps they need to clear their desks in order to start distributing the new recalled petitions among themselves...didn't they state they were going to process those first?

I'm just guessing, and still hoping to receive something in the mail by next week.

My guess is the problem with our recalled VISA's is the government's new problem dealing with a recall. Who how and where are oour recalled cases sent? How do we know they aren't on a ship in the middle of the Atlantic or Pacific right now???????

good news everyone!!

I just received an email saying that the RFE is on the way to me...yeah!!! Our case was put into the system on Apr 24. So maybe VSC is sending out the RFEs to everyone regardless the NOA1 receipt date.

Yes, they don't have a clue. I guess I got lucky and talked to someone who knew what they were doing. I had to call multiple times to find out they actually have my petition. It is possibly the worst customer service experience I have ever had besides the MVA!

I also emailed my consulate and the NVC and asked them about it. Once I knew it was not in their hands and had emails stating the consulate or NVC did not have it, I kept calling the USCIS and let them know it had to be there and it was found.

Well I know mine is not on a ship because Vermont confirmed on the phone that they received my petition on June 1st. But I have not been able to call and ask if my case has been assigned to an agent to send out the RFE. Who the heck knows whats going on, and I was hoping the electronic system would update....but I guess its too much too ask. :whistle:

Do the emails first, that way you know the NVC and consulate do not have it. Once you know this just let the USCIS know this and insist they check for your petition. I'm lucky I'm on vacation now and I had time to do it. The emails can be sent at any time, just make sure you include your receipt number and specifically ask where your petition is and/or where it was sent. Both emails are similar depending on your case.

Consulate example for petitions with NOA2:

To whom it may concern:

case id#

receipt#

My name is xxxxxx and my fiancee's name is xxxxxx. I received a notice from the xxxxxx consulate on xxxx informing us that our case was ready to be further processed. On xxxxx someone at the consulate called my fiancee and said our case was being sent back to the USCIS. I realize all K1 cases after March 6th have been sent back at this point due to IMBRA. I fall into the category of the applicant that will receive an "immediate" RFE. My questions are specific to the consulate:

Why was I not informed by letter, email or phone by anyone at the consulate that my case was being sent back?

Will my case still be expedited at the consulate due to my petition already being approved on xxxx, 2006?

I look forward to a clear and concise response.
