I hate the fact they don´t update my status since my petition was recalled!

I´ll never know when the RFE was sent.

I honestly don´t think the recalled cases will be expedited.

It sucks to be in this situation.

I´m calling them tomorrow.

I know it really gives you a feeling of uncertainty. I called today after I saw a few people were told there RFE's were either being sent or are baing prepared now. So I called and the woman said that they haven't accessed my file yet for the RFE. SO I asked about these being expedited and she said she doesn't know anything about that. I told her that isn't it in their rules that if our cases were due to USCIS error our cases are then expedited,a nd she said I guess so. What kills me is the fact that the people I saw that were told their RFE's are being sent, have a later Receipt date than me. I am assuming they have no order. Believe me I am happy for those getting their RFE's and those who can file now with the new form. It just stinks that their is no order based on Receipt date.

I mean, how hard is it? The petitions were already approved, so get those and send a RFE.

I wish we could be downloading the template and sending it. I hate depending on them.

And I think we can only ask for than to expedite our application because of their error when submiting the RFE, so we´re really up to what they will do now.

If they did mail it today some people might be getting it either tomorrow or saturday, right?

Let´s wait and see. Maybe they won´t change our (recalled petitions) status on the website and the phone officers won´t know they have mailed the RFE.

They are really good at buying some time.

That could mean anything.

I´ll call them tomorrow as well but I´m pretty sure I´ll get the same answer.

I mean, there´s nothing to be reviewed. It´s done. It was approved. The only thing we miss is the IMBRA request. I hope by review they mean "sending the RFE".

ok, here is my spin on the situation.....could it be the reason why Vermont is sending out the RFE's(or so it seems) to the later petitioners (not the recalled ones) is because they are already sitting on theirs desks, and not in a pile in a separate room somewhere? Perhaps also this is the reason why the electronic system shows them, and doesn't show us because we have been approved already? Which does not go to show that ours are not being worked on either....just maybe its not as easy to track??? Perhaps they need to clear their desks in order to start distributing the new recalled petitions among themselves...didn't they state they were going to process those first?

I'm just guessing, and still hoping to receive something in the mail by next week.

Shouldn´t they be looking for petitions submited after March 5th?

I hope they have a system instead of just looking to their desks.

Look everyone welcome to the USA Birzaro world of immigration. IN the magical land of Bizaro USA, those who play by the rules and file properly and obey the rules are penalized and mistreated. But if you break the law and do things illegally you are rewarded (refering to certain group of 11 million people who just protested for their "rights" and will be given citizenship because it is the "humane" thing to do)

Just remember we are americans ( and americans to be) and our governement will use and abuse us, because thats what americans let our government do. God bless america.

You can never put it much more better than this.With all the advancement in computers i wonder why USCIS have managed to put so many genuine applicants on hold with a huge degree of misinformation.I read somewhere on this forum abt this woman who called one of the service centres and was told K3 is not affected. Somewhere in this forum, it seems to suggest it has been affected.I went through the same plight of misinformation, i had been told earlier my petition will take 2 to 4 weeks to be procceed by the customer service and pegged all my plans on his information, am sat here still waiting.I wonder the location of these call centres, very far from the reality on the ground.

If 11 million illegal immigrants can take on the street and senate is devouting its huge resources in considering their case , what about we the genuine law abiding citizen ?

I can't imagine the number of people who have probably have their relationship wrecked because of this ambiguous and delays in all this visa categories.

My situation is even worse, there are so many important decisions i have to make in life but it seems to have all hindered on if my wife will come,when will she come, will she be granted the visa, can i buy her car now that i have had a good deal from my dealership ? can i book our holiday now that the fares are cheap ? should take up this lucrative foreign assignment for my company then my gut feelings say what if you leave and there is RFE ?

Relationship it self is a full time job but when these added heachaches is added to it then one goes insane.I feel like my life is in the hands of these incompetent federal workers whos sole mission is report to work, get paid at the end of the month and dont care about the need to reach any target or timeline or consider doing over time like most private businesses.I think is about time some of these processing department get privatised or subcontracted

Most countries i have seen have the most efficient and simple process in place, with over countless number of visa categories here in US , there is nothing you can expect than delays and #######-ups.

In most countries is all about ticking which visa you want and various visas come under 3 broad categories, Family,student, visitors .Here in America the process is so complicated , send this here, then you get this it goes there no wonder some has become victims to this unscrupulous lawyers who sole mission is to extort as much as they can and deliver nothing.

I hope am not been seen as a nagging desparate husband.

Hope visa journey will start granting a degree program in immigration for waiting spouses and fiances cos the waiting is a full time job !!

I hated to be the pessimist in the midst of all the good news, but when they say 'immediate' RFE's, what exactly is the government's definition of 'immediate'?

If its the same as their BS 90 day timelines they're good at tossing out, I would assume 'immediate' would be about 3 weeks from now.

But since there's lots of spotlight on them now, that might nip that in the bud.

Well i'll jump in on this particular comment because it is part of what I have been working on this last week with my lawyers. They contacted the right people it seems and have been able to put a fire under the decision makers. Also, I had my friend Mitt Romney (Governer of MA) make a call and he did so along with my (our) legal representation out of New York.

Previously it was going to be 30 days before RFE's were going to be sent out because they wanted to wait until the official I-129F form was released. However, they already had the section about the background check approved. So with some leveraging, we should now see many of the RFE's begin to be sent in the mail within 7-10 business days as of this Monday. But because of the volume, there could be a slight delay.

We can thank that those who run the DHS and USCIS are still human and sometimes the too realize how stupid bureauacracy can be. So, they saw reason in the letter and communication they recieved and they updated the notice. But, even with this news, changes can still happen. Someone there could have a different opinion, or 10,000 RFE's in 7-10 days is not plausible. But, at least it seems to be a tiny bit more expidited and they will START sending them out sooner than 30 days.

As far as any class action goes, they have decided that at this time it wont really do much good. However they are going to keep an eye on the situation and will read these message boards for possible leads to the negative outcomes of this sudden policy change and for any future effects. Not for legal retribution, but for "bug fixing" so to speak in the programming code of new law.

Well 7-10 business days is standard response for "immediatly" with most companies in the world, minus the beaureucracy wait period for 30+ days in this case. That doesn't mean some could be sent sooner, and it also doesn't mean some wont be sent until next week sometime or past the 10 day timeline given. There are 10,000 that have to be looked at, and then sent out. They don't have an image scan of each of our 30+ pages of our cases, so they do have to be seen by eyes to ensure they need an RFE (some might have gotten recalled and shouldn't have been, for one example).
