I still think we need to wait and when we get concrete news about what the new procedure is we make a thread for it.

This thread has certainly turned into a very popular one. I have been spending a very few moments online just to see what is new. Looks like something is gonna break soon. As far as a new thread goes that is up to the Captain. He has been directing people here to talk about AMBRA. If he thinks it's a good idea then it seems good to me. This thread can stay open for people to talk about it and a new one just for KNOWN facts is fine by me. You out there Captain? What you think?

P.S. I am having a WONDERFUL time here. This is something I have needed for a long time now!!!!

Yay GaryC in the Phillippines!

I am not a practicing attorney. I have a law degree and I passed the bar exam, but am not admitted to practice because I got a job in legal publishing and haven't gotten around to applying for my license yet. Publishing is great, but it does not make you qualified to give legal advice. So I don't. I just want to get married to my fella, which is why I'm here! If you need legal help, seek the advice of a licensed attorney.

I think a new thread wouldn´t hurt, but right now we have nothing else to do except for collect information and share our guesses...

So it would be pretty much the same thing, only in a thread not as long as this one..

I agree with Luis&Laura that once we have information about what to do it would be good to have a new thread to discuss the procedures.

Anything is good to me.. as long as you guys keep sharing your comments. It´s been really helpful and comforting for me.

Mew,

Here are my thoughts:

- The I-129f referenced on the list of approved collections is the existing one. Note the burden and cost numbers, and the expiration date.

- The new, draft I-1297 is a revision to a currently approved collection (the existing I-129f), the revision being the collection of IMBRA information.

- The new, draft I-1297 is currently on the list of collections under review, received 7 June. Wil it get review and approval in only 1 or 2 days? I've no idea where it would fall in OMB's list of priorities.

Yodrak

If you click on the "Return to the agency list" at the bottom of this page (http://www.whitehouse.gov/omb/library/OMBINV.DHS.HUD.html#DHS), you'll get here http://www.whitehouse.gov/omb/library/OMBI...IST_OF_AGENCIES, and the title is "OFFICE OF INFORMATION AND REGULATORY AFFAIRS - INVENTORY OF APPROVED INFORMATION COLLECTIONS".

So I'm guessing it was approved. What do we have so far?

1. A drafted version of a new I-129F, which complies with both the LIFE Act and IMBRA, with a 60-day notice and a 30-day one, both showing the same OMB;

http://www.uscis.gov/graphics/formsfee/for...-129F-DRAFT.pdf

2. A Paperwork Reduction Act submission regarding a new I-129F that says "Revision of a currently approved collection" and requests an emercency review with approval requested by tomorrow (with the same OMB)

http://www.uscis.gov/graphics/formsfee/for...i-129f_83-i.pdf

3. A list of approved information collection that says:

http://www.whitehouse.gov/omb/library/OMBI...HS.HUD.html#DHS

OMB NO: 1615-0001 EXPIRATION DATE: 06/30/2006

RESPS:200,000 HOURS:100,000 COSTS(000):$1,900

Petition for Alien Fiance(e) FORMS: I-129F

Anyway, guys... If this form is actually approved by tomorrow, we will be getting news soon. Let's just try and relax... (to start feeling all anxious again if it isn't approved and we don't hear anything soon). So... I'm guessing a good way to find out whether the drafted form actually was approved is by checking USCIS application procedure site (http://www.uscis.gov/graphics/howdoi/fianceapp.htm). Although I doubt that they'll actually make the new form available tomorrow in case it's approved (and then it should be there on Monday, maybe?).

Someone wrote that because of "Bi-specialization", the I129f apps were going to be processed by California and Vermont...this is the restructuring that prompted the massive transfer of cases from Nebraska to California. But, I did not have a sense that any (or many) applications were transfered to Vermont for processing. Did I miss some member's reports? I recall maybe one being transfered to Texas (?), but all else went to California. How fair a distribution is that?!!

We have heard of the 1000 some returns of apps from Consulates to Vermont. I wonder how many actual pending applications were transfered from Nebraska to California...does anyone have a sense of the backlog at this point?

Unfortunately it makes sense to me..

The approved petition on the OMB website expires on 06/30. Not only the draft but the actual I129F expires on that date. So it could easily be any of them...

There´s one thing that I´m thinking about, though. The statement from 05/26 says that USCIS had already submited and requested the approval.

So why would they only send the request on the 7th of June?

I don´t know, but the approved form can be the draft..

As for "Wil it get review and approval in only 1 or 2 days? I've no idea where it would fall in OMB's list of priorities", I think you´re right.

No one here seems to have an idea of how OMB works, especially under an emergency request.

Maybe it can be done. Otherwise why would the USCIS and DHS request so?

My guess would be because Vermont has their hands full right now with the 1000 odd petitions sitting at their facility waiting for some action. They are *somewhat* backed up. this of many reasons maybe is why they haven't transferred any additional petitions to them yet. Just a guess :D

Ok, I think I may have figured this out. The draft on their website is the new form. If you actually open the draft, it contains the new questions, but the man hours are now back to 100,000. So this is how I see it. The requested the emergency approval. They must have gotten the approval, but since the I-129F expires 6-30-06, they now need to extend it's usage. So Either one of two things. One, they were denied and were told just to add it to the extension, or two they got approved and now need the extension, but means they can begin processing.

I think it is the second, which means they have an approval and why would they go for the emergency if they weren't going to start using it immmediately. Why wouldn't they wait for the extension. But, how can they extend something that doesn't have the correct questions????

I believe we will be getting great news either today or Monday.
