Just to add my progress here, my NOA1 was March 13, NOA2 was March 16, NVC sent the petition to Manila on March 30. I received an email on May 24 from Manila stating my petition was being recalled. I e-mailed the California Service Center on a lark (even though I went through Vermont) and they seemed very helpful, stating that they contacted NVC and they still show that the petition was sent to Manila on March 30. After emailing them yesterday, I discovered they didn't actually send out the petition until June 2. Which is strange, since I've yet to read of anyone with such a late mailing date. I'm assuming now that most Philippines cases will have this timeline...I just hope that there is some kind of order kept so those with earlier NOA dates are processed first, but I realize that's not very likely.

I think they'll probably work on the recalled petitions in the order of the received forms. I mean, whoever gets their "RFE" new I-129F sent first will get their case worked on first, and they'll probably do a fast job on those that answer NO in the IMBRA question with no criminal background and send those back to the consulates and embassies in top speed, so they can go back to processing the cases not yet approved but filed before IMBRA.

ok guys here is a REAL update on my situation. First of all the method to call vermont worked :thumbs: thanx

At first the gentleman said that he does not see it in the system, and that they received back thousands of them and it is possible that its there and just not entered. Then I kept him on the phone with all sorts of questions. Meanwhile he had looked up my fiances A# and said that they did in fact receive my petition back on Jun 1st!!

next step:

---they are still waiting for instructions from headquarters in Washington on how to proceed with these petititions. He was optimistic that it will be soon, although he was not sure.

-- he suggested looking online to see what they are requesting from the new 129f petitions, and said it may be similar to that for us, BUT he does not know for sure.

-- in response to if our petitions will be processed in the order of the priority dates, he said he sure hopes so, but again he does not know how deep they are going to dwell on this situation, maybe they will just use their own means of running background checks and then just notify us by mail that they have forwarded the petition back to NVC for them to send to the embassy abroad.

He also said that we the petitioners probably know more than they do anyway, :lol:

Be sure to put: OMB Control No. 1615-0001 in your email subject line

One specific point they want comments on is:

(4) Minimize the burden of the collection of information on those who are to respond, including through the use of appropriate automated, electronic, mechanical, or other technological collection techniques or

other forms of information technology, e.g., permitting electronic submission of responses

so here is our chance to tell them that we want to be able to fill out a form online and email it back to them.

Ok, the previous notice was the second notice (30 day). Here is the 60 day notice, which states they wanted all comments before May 1, 2006. Then the 30 day notice would take effect, which would put it at June 1, 2006. The next process is the one I posted earlier today which ask for the approval by June 9, 2006. So the picture seems to becoming clearer. They are finished with the comment stage and now they are trying for the approval, which we all hope comes before Friday the 9th. My friends, everything looks like we should know something by the end of this week. So keep calling the service centers, and checking the forms section.

I hope we all have good news on tomorrow!!!!

If this is all true, and I hope it is, they should approve the form, right?

I don´t know anything about OMB, but since DHS wrote the form it should be ok with the security needs...

So, this is ironic for me.

I should be flying (if my interview hadn´t been cancelled) on June 9th to USA.

When they cancelled I thought that would be the saddest they ever, but if we do get a good answer by then, somehow I´ll celebrate even more. :)

Do you think they will wait till the next minute to approve the form?

But if you think about it, it does make sense.

After these 30 days they released the draft, and requested it to be approved by June 9th.

Now, all we need to know is if they will approve it.
