Although it´s in review the one thing I liked about it is that it says it´s in emergency review, which shows that at least they´re trying to put it up fast, this new form, and from what I understood, it seems they might make it e-fillable or something, to faster receive and process it.

So this is good news indeed, right?

I think it has to do with K-3.

(4) Affected public who will be asked or required to respond, as

well as a brief abstract: Individuals or Households. This information

is collected by USCIS to determine whether satisfactory evidence has

been submitted by a U.S. citizen to establish that the parties are

married, in the case of a citizen seeking to obtain a nonimmigrant visa

for his or her spouse.

It refers to us as well: "In the case of a citizen seeking to obtain a nonimmigrant visa for their fiancée, if this information is not collected and presented to the USCIS there is no mechanism for the USCIS to determine whether satisfactory evidence has been submitted by the U.S. citizen to determine that the citizen and alien have previously met in person within two years before the date of filing the petition, have a bona fide intention to marry, and are legally able and actually willing to conclude a valid marriage within ninety days after the alien’s arrival in the United States."

So this is good news indeed, right?

All it means is that there is an I-129F coming. Whether that is good news as to the IMBRA is anybodys guess. That would depend on if there was extra questions added pertaining to the petitioner and the background checks.

They are just incorporating the old language into a new I-129F.

Timeline

It appears it may be just looking for input on the current form and as a possible document review. The form it points to is dated 10/26/05 and it expires on 06/30/06 so they are reviewing the documents as per a time line they have in place for validity of these forms.

So if there has been no changes and the current form is set to expire shortly then it does not appear that a new I-129F is something that is going to be needed so as mentioned it may be a seperate questionaire or something along those lines by the looks of the time frame they have setup.

All it refers is to the current reason why there is a I-129F and the purpose of it. This is the wording when it was first revised years ago as to what information it would collect and what the information would provide.

Don't worry, our turn is coming soon. The current I-129F expires on 6/30/2006, so something is going to happen soon.

I think the information from the Federal Register that everyone is assuming refers to a new IMBRA-compliant I-129F is actually refering to the Paperwork Reduction Act. The PRA requires that they do this every so often, getting info on how long the forms take people to complete, how long they take to process, etc. I wouldn't necessarily assume it has anything to do with us.

I am not a practicing attorney. I have a law degree and I passed the bar exam, but am not admitted to practice because I got a job in legal publishing and haven't gotten around to applying for my license yet. Publishing is great, but it does not make you qualified to give legal advice. So I don't. I just want to get married to my fella, which is why I'm here! My opinion (and its only MY opinion) is that they are slipping behind at an amazing pace. They will do something quickly or they will be in a world of hurt with a quicksand of new paperwork that needs to be done. I think we will see some action soon. And I also think they will make it as easy as possible to make it happen as quickly as possible. It won't be long and we will have something to fill out and send in.

It's the Paperwork Reduction Act that requires form revisions to be subject to a public review and comment period. The reasons for review of I-129f at this time may well include proposed revisions to implement IMBRA requirements.
