This is all so very frustrating!! I keep checking the USCIS web page for information regarding my application and nothing, only the fact that the NOA was mailed out in March, no touches or nothing. I was hoping that Luisa would be here in the states with me by August, it seemed like a feasable date when initially looking at the timeline process dates, but now it looks like I will be lucky if she is here by Christmas!! I am all for Homeland Security and also protecting women from third world countries, but really find a way to do this without all the delays. AAARGH!!

3/21/06 I-129F sent to NSC

3/24/06 NOA1

3/28/06 Touched

6/1/06 Case transfered to California Office

6/2/06 Touched

6/3/06 Touched

6/9/06 Received 2nd letter from NSC telling me that my case as been transefered

6/14/06 Received 3 emails today saying that CSC has my application

6/15/06 Touched

6/16/06 Touched

6/17/06 Touched again

7/3/06 Received RFE today in mail along with 2 emails

7/3/06 Touched

7/6/06 RFE received in California

7/13/06 Received email saying RFE had been received

7/31/06 Received (3) emails saying my application has been approved

8/1/06 Touched (hopefully that means that my application has been mailed to NVC

8/15/06 NVC mailed application to Bogota

8/25/06 Luisa received Packet 3 from Embasssy!

8/28/06 Luisa hand delivers Packet 3 to Embassy!

9/6/06 Luisa receieved Packet 4 from Embassy

9/18/06 Medical Exams

10/3/06 Interview Date!!!

10/4/06 Have Visa in Hand!!

10/16/06 Return to EEUU

01/06/07 Married..... Now trying to complete the EOS stuff!!!

07/02/07 Green Card Interview, we were approved!! Now we wait for the actual card!!

07/18/07 Recieved Green Card in the mail!! Yippeee!!!

I just check the processing date for VSC, it has just reverse back on 06 March 06.

I think it is good... at last they are now start working on the issue that get impacted by IMBRA... Hoping and wishing they are able to move thing faster…

2005-Aug – Attorney mishandling our case, they told us will expedite our case

2006-02-16 to 2006-03-09 - With my fiancé in US for our new apartment move

2006-03-13 - NOA1

2006-04-10 - Sent email to Embassy for Packet 3, Consular advice Packet 3 has sent on 10 April

2006-04-21 - Received Packet 3!

2006-04-24 - Sent DS230 Part 1 and Checklist back to Embassy

2006-04-28 – Self collected Packet 4 at Embassy and make appointment for medical

2006-04-29 - Medical check-up

2006-05-11 - Interview Day!!!! - APPROVED!!!

2006-05-15 - Submitted my resignation from work

2006-05-17 - Got a call from Embassy, my visa issuance ON HOLD due to new law IMBRA, they are not able to issue my VISA!!!

2006-05-19 - Pick up my passport without VISA. No information as to when my VISA will be ready...

2006-05-22 - Embassy inform that our case has sent back to NVC via FedEx

2006-06-24 - Last day of my job after serving 1 month notice. (Manage to extend my last work day to 6/24)

~~~ Still don't know what they need from us...

2006-06-25 - USC's finace fly to Malaysia...

Yeah, I just checked Nebraska. They moved theirs to Feb 22. The fact that they moved it is hopeful that they will start again.

Since we now know that K3's and petitions before March 5 will not be impacted the next time I update the list I will eliminate those lucky ones that will not be delayed. The rest of us will just have to sweat it out.

I just got this email from my lawyer. I emailed him the DHS memo and asked him about the RFE's that may be coming. This is what he said:

Lots of confusion happening within this thread as to the roles of USCIS & NVC (Department of State)

They are two completely seperate entities. USCIS cannot request Consulates directly to return petitions.

USCIS would of sent a directive to NVC to recall all petitons with a priority date (received date on NOA1) of March 6 and later.

NVC sent a directive to Consulates where the petitions in question were forwarded.

Consulates then send these petitions back to NVC

NVC will then forward these petitions to the service centers from wence they originally came.

USCIS will then do the required IMBRA checks

Petitions will then be rerouted back to the Consulate via NVC.

You can see why when you call either the NVC or Consulate, there is different things being said....because there is.......each is its own step.

Yes it is going to take some time unfortunately for all those that had petitions returned. It will also backlog centers such as vermont, which many of the petitions seemed to of originated. But they will catch up. Hang tight everyone and all the very best.

According to the memo there are 1100 petitions that need to be returned. If Vermont has ANY common sense (I know, thats a big if) they will put people on overtime to send them back. The rest of the service centers are hopefully getting procedures in place to do the extra checks. Time will tell.

what countries do you think this is effecting?? my Fiancee lives in jamaica and has heard nothing...when i called the embassy to ask about his appointment they said nothing to me about the posibility of it being rescheduled...i don't know...andi hate waititng to find out...

If your received date on the NOA1 (not the NOA notice date) is dated 6 march or later.....it doesnt matter which country you are from........they are the ones that have been requested returned.....whether they were at Consulate already or for that matter at the NVC still.

All Need some help.

Recieved an update on my application after my fiance sent Packet 3.

The Mumbai Consulate stated in an email that the application is:

"Your file has been forwarded to DHS for review"

What does the above mean? Is it part of a normal process?

This is scaring me so much.

Please help......

I have filed the K-1 and K-2 petition for my fiancée and her daughter. Our question is can when the visa is approved the K-1 has 6 months to enter into USA. Does the daughter get to come at the same time?

Does anyone know how to explain to us the details behind this?

Does anybody know what happened to the temporary restraining order against IMBRA that was issued in Georgia or Ohio? Could the government be waiting to find out the decision before they act?
