I´m in the same situation as you.

Unfortunately, USCIS will only review the cases once they have it back. That´s why they recalled all petitions around the world.

I think they can´t say: "Ok, the petitioner here is a woman, so they should be fine". That would be descriminating men. At least that´s why this new IMBRA law is gender neutral.

It sucks for me too. In my case, the USC petitioner is also the woman. And we did not met via an agency.. not even online. We provided evidences of how we met in person and they had alreday approved it.

What I think is that we won´t have much trouble after they start processing our case. But who know how long this is gonna take to finish.

The USCIS officer told me on the phone that I should give them at least 30 days to call them back just to see if they have received the petition back! Of course I´m calling them again next week...

I think the thing is that we need to ask now for general questions, since they really won´t give us any specific answers about each case.

We need to ask them if during this security-check they´ll ask us to provide anything else, if our petitions are going to the end of the line, etc.

Before they receive our case back, that´s the far we can go.

I have no more job, and soon will have to move. I had everything planned. Now, I don´t have a clue of how long this is gonna take.

I think from tomorrow, you should also call your fiancée´s Consulate in the UK, the USCIS and the NVC in London.

I´ll be doing that and we can all share information here.

Good luck to us all! I really can´t take this anymore. I´m not doing well.

... and here I was: sooo jealous that the Vermont Center moved so quickly, and wishing I could file there instead of Nebraska. But it looks as if most of the returned petitions came from there. :( it's just sad.

I'm hoping those cases get re-approved quickly.

AAHH..as it is getting closer and closer to the interview date(already booked my plan ticket)...i get more and more worried... I called the embassy in JA to find out when his appt. was for and she told me and didn't say anything like well that might change...i asked her if it was safe to book my flight and she said yes..i am trying to make sense over everyone who is getting recalled...and really can't see a patern yet....i just wish there was some way in knowing if it is going to be recalled rather than waiting day to day praying that he doesn't get a letter or call saying it is canceled.....

Your NOA1 date of March 10 ....is that the received date or the notice date on your NOA1?

On our NOA1 the Receipt Date is 3/1/06.

On our NOA1 the Notice Date is 3/7/06.

I don't know which date is the IMBRA tracks against.

The NOA2 has Receipt 3/7/06 and Notice 5/8/06.

The receipt date is used for everything else so I cant see this being any different. The date your petition is physically received and date stamped is the recieved date on the NOA1. This is the date that is used during the processing of the petition and the date one also uses to guage against the date they are currently processing when you check processing dates.

I think it´s pretty clear now why the petitions recalled come from the VSC.

Only Vermont has approved petitions dated after March 6th.

At some point, USCIS realized their mistake and started doing this new sec. check to the petitions they already had there.

But all others forwarded by them were no longer considered approved.

That´s the pattern, I think.

Also, as my opinion: they needed some time to adjust (or maybe they are still adjusting) to the new law, and probably because of this new law, the whole proccess is gonna take longer from now on.

The petitions that never left VSC should be approved soon, unless they are still trying to find out what to do. Or if they will proces the recalled petitions before the ones already there.

I think we will only know these answers when someone who got their petition recalled gets contacted either by USCIS, NVC or the Consulate. Maybe for a rescheduled interview, for a new NOA1 or for a RFE.

Seems like Vermont has stopped processing the I129F´s. We should call them and ask if this is true.

Thank God tomorrow is a monday...

Why would Vermont have stopped processing I-129F´s? They must keep processing ours and the recalled ones. The thing is Vermont approves faster than the other services so when they saw the mistake VSC had more petitions approved than the other services and now have more to fix. I´m waiting to see if the recalled petitions are gonna get reapproved or if the ones that are still waiting for NOA2 will get theirs anytime soon.

That´s precisely what we need to be asking, WHEN will the processing restart, and WHO are they gonna process first? They can´t just stop and leave us waiting.

On my NOA1, it doesn't say RECEIPT date, it says RECEIVED Date and NOTICE Date. Only the NOA2 has a Receipt date on it and it's the same as the Notice Date on the NOA1. So... I believe they'd use March 7th as your petition date :huh: but who knows. We've already seen that people's NOA's do not all look the same/have the same information on them, so if your NOA1 does have a receipt date, they would maybe go by that instead

Luis&Laura, I only think Vermont might have stopped processing I129F´s because there´s no notice of any approval lately.

The other Service Centers are still processing, but they still have petitions dated before March 6th.

Maybe none of the Service Centers are procesing any petitions dated after the IMBRA law.

THAT´S MY GUESS. It does make sense to me, after all I´ve been researching.

The reason for me can´t be because they are waiting for the recalled petitions. The petitions only started being recalled 10 days ago, and they got frozen before that.

I think they are still waiting to know what to do.

Maybe when they do they will realize that they didn´t need to recall it, I don´t know.

But if that´s the atcual situation at USCIS, it´s the worst it could be. Because it means they don´t know what to do about the new law yet.

I´m sorry.. this is how I react to situations like this. I can only think it looks really bad.

But THEY NEED to let us know, what is happening with ALL petitions submitted after March 6th.

My Bad! You're correct. The NOA1 has RECEIVED DATE MARCH 1, 2006 and NOTICE DATE MARCH 7, 2006.

The NOA2, the "Approval Notice" with the "Valid from" also in the "Notice Type" box has

RECEIPT DATE MARCH 7, 2006 and NOTICE DATE MAY 8, 2006.

If they know we are claiming for an explanation they will say something.

Since my interview was canceled, everything changed in my life.

I am spending the money I saved to buy my plane ticket to bring my fiancée to spend 5 days in Brazil next week.

I think spending time together will make us stronger to wait for "who knows how long".

I need to know what´s going on. I can´t live like this. Did you guys realize that this is the first time since the beggining of this journey, that we don´t know what´s gonna happen?

I mean, not that the money is the most important thing here, but we spent a lot at this. Is this even legal? To recall petitions and don´t say a word?
