K3 visa related questions

Hopefully someone can answer these questions

If you have just been married and filing for K3 visa, what do you do for the following

1) Bonafide evidence of your marriage for I-130. I don't have the first four. Can somebody share the contents of following affidavit for I-130? And is it ok to get the affidavit from relative who attended the wedding?

Here is what I-130 says:

Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage);

2) What do people submit for proof of ongoing marital union when you just have been married for I-130? Do you submit travel itinerary, wedding pictures, phone records prior to wedding, letters prior to wedding? Anything else?

3) When you file I-129F, do you submit the items mentioned in 2 with it. The K3 guide doesn't talk about it.

4) Do you have to wait to file I-129F or you could file it simultaneously with I-130? From the posts here, it seems like some people file it simultaneously.

5) K3 guide talks about including NOA1 for I-130 and Copy of I-130 Transfer Notice. Can you file it after getting NOA1 or do you have to wait for transfer notice?

1) USCIS and Consulate know that you cannot produce this type of evidence if you have only been maried a very short time, so you can provide the 5th "Affidavits" from friends or family who know of the marriage.

2) As above get some letters from friends and family.

3) All the required evidence is with the I-130 for (CR-1 visa) it is not needed for the I-129F which is only being used to get a K-Visa

4) You have to wait for NOA1 letter from I-130, to file I-129F

One last note, consider just doing CR-1, for most countries CR-1 is taking just a bit longer to get than K-3.

Here is a big reason, Does your spouse want to: WORK, apply for a Driver's license, get SSN? K-3 cannot do any of these things until they either have EAD card or Green-card. EAD can take 90 days or more to get. Adjustment from K-3 costs $1010, CR-1 is lower in cost, $400+70 fees to NVC.

Compare timelines.

Since you did not bother to fill in profile details with things like foreign citizen's country, I cannot give you better estimates of time comparison.

Thanks for your quick response YuAndDan. Few questions and clarifications still needed.

1) Can somebody provide sample affidavit from a friend/family member for I-130?

2) Two affidavits should be enough for I-130. For I-130, then I don't need to submit any other documentation for

ongoing marital union like wedding pictures, phone records etc. Is this correct?

3) During filling form I-129F for K3 visa, do people submit wedding pictures, phone records etc to show ongoing marital union. Can somebody provide a detailed list?

I am from India and I am doing preparations for filing.

Newlyweds who have never lived in the same country can simply skip sending anything from the "should" list and bring their bona fides evidence to the interview provided they've sent the things from the "required" list.

This worked for me with no problems.

Dear Ye Ye,

When I filed the I-130 for my wife, I included the copies of the wedding license, Statement from Mom and Dad, pictures of the wedding banquet, pictures of me with the family, and emails. It was approved with no problem.

If you do not have a child, I would recommend not filing the K3. Just stick with the I-130. The time for approval is about the same and you don't have to adjust status once your are in the US. You can look on the website here for more info on which is best for you.

you said you included the statement from your parents with I-130. Was that an affidavit? Could you share the contents so I could also make similar affidavit.

For K3, could you share what you submitted with I-129F to prove ongoing marital union? Wedding pictures, emails, phone records, anything else?
