I need :help: !!!!!

OK, to fill you in: My fiance (american) and I (german) filed for the K-1 in February, we just recieved the NOA2 and waiting now for our papers getting sent to NVC.

So far, everything is cool, I started collecting all the other required papers, he works on the Afidavit of support.

Now--he is in the USAF, stationed in La. and he was told, he might get stationed in Germany in the fall. To me, this means, we might be able to get married in the States after I get my visa approved, but then I would not have time to apply for AP nor AOS because he would be in Germany.

My question is: Can I put my visa application on hold or completley stop it, wait for him to come to Germany, marry here and then do DCF???

Does anyone know, if something like this is possible/happened before?

Or any other ideas what I could do now?

I expecting to get my K-1 in July/August, but he would already come to Germany approx. September.

My wories with just stopping everything is, that it might look bad to the USCIS, like I didn't know what I want, if all we want is finally getting married and start our lives together...wherever it would be... (L)

Lots of military members that will be able to help you out as far as what you need to do. You could try doing a search for some members posts eg jodee who was in similar or same position from memory.

Thank you, I guess, I will send jodee a pm, if I am not getting any more replies on here. I have read all kinds of topics already, but so far, it was nothing that could really help me in my case.

Well, maybe some more people will read this and have some ideas...

I too can imagine that people in the military face this issue a lot more, so I am hoping, this is nothing that can't be fixed.

And I guess, I could call the embassy in Germany as well, to ask for advice?!

Im quite sure as a military wife, all you need is to on his travel orders as a dependent. and dont need AP etc. Have your fiance check it out with the JAG's office where he is stationed. They should have some good information.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

I've read a few cases where JAG was relied on for immigration information and they got it completely wrong!

With regards to getting your visa issued close tou your fiance's deployment time, maybe you can control that. You won't get an interview date until you return Packet 3 to the consulate. You could delay that while you investigate whether DCF is an option.

Yea, so far we haven't gotten any useful information from JAG at all. We already had an appointment with them before we started the K-1, just to see what info they could geve us and yea..it was nada..lol

But if we got married in the States and I got on his orders for the assignment and I didn't need AP, that would already help!

Usually when you are in the military, they waive all residency requirements. Think that it applies to dependents also, but not sure. That is what you need to find out. Im sure there is something about it somewhere on the USCIS site.

If you're not going to live in the US, you don't need permanent resident status; that's how you handle that if & when it comes up.

Until then, all you can do is move forward as if you will be staying in the US, or risk delaying your move here.

If you get the K-1, come to the US & marry, you'll be able to go on his orders IF he gets transferred. When it is time to come back to the US, you can DCF nad come back on an Immigrant Visa.

If he doesn't get transferred, file for your AOS as planned.

Or am I missing something?

And important was your "IF he gets transferred"...lol there is a great chance, but he hasn't gotten the orders yet, so I am in limbo..I just freaked out and got all worried because we are so close to everything already, and I just want to get it over with...without major new things interfering(sp?)

But if I could just go on as planned and then just add DCF once he is here, that would be cool with me!!

Hmm..now thatstill rises another question....if I left the States after getting married on the K-1 and left again without AOS or AP, and let's say we wanted to go on vacation in the US...can I actually do that? Just as tourist again on an I-94?

Yes, you can return as a VWP visitor, even after expressing immigrant intent, if you are really living abroad. Your best proof of this is showing your husband's ties overseas and that he is not living in the US.
