Hello there. Anyone could answer me? I came here as K1 and after a week got married we immediately filed my AOS and now I already have ASC appointment notice for I-485 this July 02, 2008. I just want to know if its fine to go to the USCIS Center by myself (i mean without my husband presence because he has work)? Is this appointment is only for me?

This is YOUR application not your spouse's and only you are required to attend. Anyone who comes with you will not be allowed past the waiting area anyway.

YMMV

WHAT?! For the AOS interview?? The spouse is required to go. Tell your husband to get off of work. If you go by yourself you are going to have problems, or get denied all together. You are there to prove you have a valid marriage. Only 1 of you being there won't prove that.

Check out her timeline, she had biometrics in June. 7-2-08 is the date she entered for AOS interview date.

Note, when we were at the field office for biometrics, there were several couples being interviewed for AOS.

It is quite common for both persons to attend the AOS interview, and they do ask US citizen, and alien spouse questions to determine if marital relationship is bona fide.

FAQ: http://www.visajourney.com/faq/k1k2visa-aos.html#6.11.3

US Citizen is allowed to attend and sometimes is required to attend AOS interview.

If this is for BIOMETRICS, then No US citizen is not needed there for that, biometrics is just fingerprinting, and a picture.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Is now a US Citizen immigration completed Jan 12, 2012.

OK, but it most likely is not occuring at the ASC but according to YuandDan it could

I honestly believe this is the biometrics notice for the I-485 which could have been done with the biometrics for EAD as there is almost no way to have an AOS interview 5 weeks after application... at least not in today's environment....

Tintin, is this appointment letter for biometrics or for AOS interview? If the latter, then your husband is required to attend. Bring all documents as specified in the appointment letter. Good luck!

There are some weird dates in OP's timeline: she got an RFE (dated June 1) before her NOA (dated June 5)? Something makes me think that her biometrics appointment letter is dated June 19 (which she entered as the Bio date in the timeline), but the actual biometrics is to take place on July 2 (which she entered as the Interview date in the timeline). I would tend to agree with fwaguy that an interview so soon is quite impossible.

For AOS what? Your AOS Green Card interview? If so, your spouse must attend the interview unless he is in the Armed Forces and deployed prior to July 2nd. Your interview notice should clearly state that. If he can't get off work, he'll have to call in sick.

I-129F

10/23/2006 - I-129F approved (97 days from CSC)

AOS

03/03/2007 - Married!

03/14/2007 - I-485 + I-765 sent

03/21/2007 - NOA1, Checks cashed

06/01/2007 - EAD card production e-mail received (74 days)

07/27/2007 - EAD RECEIVED (57 days after approval)

11/29/2007 - Infopass appointment - file was sent to a storage facility before it was finished processing.

05/28/2008 - Received AOS Interview notice

07/10/2008 - AOS Interview-APPROVED pending fingerprints

09/22/2008 - GREEN CARD IN HAND!

ASC appointment is for biometrics, you can go without your husband.

For AOS interview, "if your eligibility is based on your marriage, your husband or wife must come with you to the interview." (you can read that to your interview appointment letter).

Hi Walls, thanks for your reply...I am just confused because i'm done with my biometrics on June 19 and then i will have an appointment again on July 02...Both appointment letter i got were ASC. I filed I-765 EAD and I-485 separately....Does this mean that i will have my biometric fingerprints twice? On June 19, they just got only one of my fingerprint...and i asked with the personnel why only because i noticed that some taken their ten fingerprints
