Hello everbody! My wife is has been running the K-3 / CR-1 in parallel and we have just received DS-3032 and the AOS Bil for the k-3.

We decided the CR-1 was better for us at this time even though we have to wait a few more months to get it. We curious how do you "abandon" the K-3 as I was not able to find a specific instructions how to do this. Thanks in advance for your help!

I-130

9/17/07 sent to CSC

9/20/07 recieved (as noted in NOA-1)

1/2/08 NOA-1 notice date create

1/8/08 NOA-1 recieved via mail. FINALLY AFTER 3 1/2 months!

The AOS bill is for the CR-1 visa path NOT the K-3, pay the fee and send in the I-864, and then pay the IV fee for CR-1 visa to NVC.

You can then do a few things,

If the K-3 petition gets to consulate ahead of the CR-1, you could contact the consulate and get the K-3 interview rescheduled for a later date, and if during that time the CR-1 case gets sent to the consulate, they will drop the K-3 in favor of the CR-1.

OR you can interview for the K-3, and then just not use the K-3 and wait for the CR-1 case to get to the consulate, and then interview for the CR-1.

Thanks for clearing that up for me and my wife, it's kind the folks on this site has made this complicated process more bearable =)

Simply don't respond to any correspondence from NVC regarding the I-130. If you've started, stop.
