My wife is from Colombia, her girlfriend is also from Colombia and is engaged to a USC. The girlfriend (fiance) is no longer sure she wants to marry her USC boyfriend. The Visa application has not yet been approved by the USCIS. The question is...

Can she cancel the visa application?

What are the ramifications for a future K1 application should she do so?

This is only my opinion i think its the petitioner who can cancel the petition,anyway she might like to contact her embassy issuing visa once it gets approve by the USCIS.(IF the USC didnt cancel the application yet)

Im sure someone here can give u advice.

At this point, the foreign beneficiary has not input to USCIS because the US Citizen filed the petition. There is no visa application until after she is contacted by the Embassy. She may simply decline to submit a visa application if given the opportunity.

If there is another USC fiance or spouse in her future, a brief explanation that this relationship didn't work out and she changed her mind, should be sufficient to cover any concerns.

Facts are cheap...knowing how to use them is precious...

She needs to tell HIM that she wishes to no longer be engaged etc. I'm hoping that she's told him this first!! Her USC boyfriend might be cancelling it after he hears the news...

Very simple solution; GF should call petitioner and tell him she no longer wants visa, and then FAIL to do the earliest step of the following:

  • payment of visa fee
  • visa interview appointment show-up

2005/11/07 I-129F approved, forwarded to NVC--to Chennai Consulate 2005/11/14

2005/12/02 Packet-3 received from Chennai

2005/12/21 Visa Interview Date

2006/04/04 Pras' entry into US at DTW

2006/04/15 Church Wedding at Novi (Detroit suburb), MI

2006/05/01 AOS Packet (I-485/I-131/I-765) filed at Chicago

2006/08/23 AP and EAD approved. Two down, 1.5 to go

2006/10/13 Pras' I-485 interview--APPROVED!

2006/10/27 Pras' conditional GC arrives -- .5 to go (2 yrs to Conditions Removal)

2008/07/21 I-751 (conditions removal) filed

2008/08/22 I-751 biometrics completed

2009/06/18 I-751 approved

2009/07/03 10-year GC received; last 0.5 done!

Only the petitioner can cancel the petition and i am sure he'll do so once he finds out what's going on.

Only the petitioner can cancel the petition and i am sure he'll do so once he finds out what's going on.
Embassy can also do effective cancellation--such as if the beneficiary fails to show up (and doesn't notify them prior)
