Finally Good News!

Ngoc's visa has been approved after review by the chief CO! I don't really have any details outside of they changed their mind. But I really don't care either, just happy we finally got it!

Best 4 am phone call I ever got!

Had to make an Info Pass appointment because there was a delay in receiving the NOA for our I-751. Never found out the reason for the delay but they gave Thao a 1 year green card stamp in her passport and we got a the NOA 2 days later.

From what Marc told me, this was a weird one. He presented our case along with some others. He was told a few minutes later that our case had been approved. I don't know why it was miraculously approved. Marc had everything laid out with all our evidence, a direct rebuttal including case law & presidents. My thinking was between me pestering the consulate, my congressman contacting them, and Marc showing up to represent me, they just wanted to get rid of the case instead of looking like idiots. I have no other logical explanation.

I think it's because Mark Ellis got the Consulate to read your evidence. Remember at the interview, the Consulate has little time to look at what you brought. Most of their opinion about your case is from what they read in your I-129f petition. If it's incomplete or confusing to the Consulate it's a blue slip. If they think there's a hint of fraud about your case, they don't want to let you have a visa. However, they have to be reasonable about that so if there's evidence to show that their worry about the possible fraud, they have to consider it. Sometimes they don't want to or they don't want to be the one who ok'ed fraudulant visa.

For example, Think about getting a check cashed at your bank, at a branch where no one knows you , usually no there wants to ok the check, they want you to deposit it then withdraw the money the next day. Even tho you have lots of money in your account and you've been banking there for years. Why? because then it's not their signature oking the check if the check gets returned to the bank as a fraudulant check. In the case of the bank, the person signing a fraudulant check could lose their job. Getting fired for taking a bad check would make it harder to get a job at another bank.

So HCMC Consulate Officer doesn't want on his record that he allowed a fraudulant visa, it could make chances of advancement, pay raises, etc more difficult.
