Hi everyone. I know the USC has to earn above the 125% povertly line, which for a family of 2 is $17,500 annually. One question I have is do they just look at the income or the loans that they have also. My fiance has a student loan and a car loan. He earns above the poverty line but I am wondering if they would calculate the earnings he has and the loans. He does not own his house he rents.

All they are concerned with is Gross INCOME before taxes and deductions, the don't care about expenses.

One thing about I-134, the directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

  • I-134 signed and notarized.

  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html

  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

The 3 years of W2s are optional, correct? Only one year is necessary.

I will be starting a ne wjob, but don't imagine it would be a problem that the I-134 and I-864 have different companies.

01-06-08 Got engaged!!!

02-21-08 NOA2 Approved

02-27-08 NVC processed petition

02-28-08 Received NOA2 in mail

03-03-08 Consulate in Rio de Janeiro received petition

03-21-08 Received packet for interview

04-22-08 Visa Interview and Visa APPROVED!

05-06-08 Visa received in mail

07-28-08 Wedding Date (Reception was 26th, but forgot to reigster for MC...oops)

10-04-08 Applied for AOS (EAD and AP also)

10-09-08 NOA1 for I-485

10-27-08 I-485 transferred to CSC

11-04-08 I-485 Biometrics appointment

11-13-08 NOA1 for EAD

12-09-08 EAD Biometrics appointment

01-08-09 AP Approved

01-13-09 AP Received

Cost of 3 roundtrip tickets to Brazil in last 3 years...... $2,900+

Cost of filing petitions for K-1 visa & AOS.................... $1,465+

Cost of monthly calling cards to Brazil........................$20

It is an income/asset requirement not a net cash flow (income less payments). If it was then most of us would be inelligible.

Yes just past year's (Compleate IRS return (1040/W2/1099)) required, additional years are optional.

You can use simple IRS transcripts, they are FREE.

And, yes you can change employers between visa interview (I-134) and adjustment of status (I-864)

Every consulate is different in what they request from the petitioner as far as the affidavit of support. Your best bet is to either contact the USEM you will be dealing with and/or check with others using the portal page here or the regional threads. ;)

Also, even though I directed my comment to a later poster in the thread, when I answer I am hoping it will answer the question of whomever is reading and not everyone is going through Rio.
