I-864 or I-864a?

Hello,

Ok I thought I was clear on this but then I read some posts and now I'm really confused.

I'm the USC- my husband and I live in London together. We are doing DCF through the London Embassy and sent in our checklist a few days ago.

I will be doing the I-864 and have filed all of the necessary taxes. I will need a joint sponsor and will be using my father.

Now here's where I am going crazy. I thought my dad only filled out the I-864a but now i'm thinking that's not correct.

He files taxes jointly with my mom however she does not work so the actual 'income' is coming from him.

So will he need to fill out an I-864 AND an I-864a? Or just one or the other? And will my mom need to fill out a separate I-864 since she files jointly with my dad?

I'm confused by the I-864a as it says it's a 'contract between sponsor and household member'- am I considered a member of my father's household? My permanant address in the US is at their house and that is where we will be initially residing once we move.

I hope I'm making some sense. Any help is appreciated. I'm glad I came to realize this now!

Your dad is not a member of your household he is in the US and you are living in London, He should be filling out an I-864 as JOINT-SPONSOR.

I-864A is for a member of household to contribute additional income to help a sponsor or joint-sponsor meet 125% povertyline income level.

To add to YuAndDan's post: If a sponsor filed a joint tax return with a spouse, but is qualifying using only his/her own individual income, the sponsor must submit evidence of that individual income. This evidence would include, for example, the sponsor’s own W-2(s), Wage and Tax Statement, and if necessary to reach the income requirement, evidence of other income reported to IRS which can be attributed to him/her, usually on Forms 1099.

So make sure to include W-2s for every year of your dad's tax filings you submit.

In your case, the I-864A would only be included by your dad on his I-864 IF your mom's income was needed to meet the 125% poverty line income level. Since she doesn't work, there is no need for the I-864A.
