any idea's of anything to do but wait?

Hi,

Our I-130 was was mailed 9/5/07 with a NOA1 date of 9/10/07. Of course we really didn't received the receipt until December 07. Our case is at the Vermont Service Ctr and we are still waiting! (as I'm sure many others are!!) They asked us for additional evidence back at the end of February which we immediately turned around and they received on 3/4/08. We've had no movement and I see others out there with receipt dates after ours that have moved on via Vermont. (it's great that someone is getting customer service!!) I've contacted my congressman's office and they inquired on the case and made follow up calls. The congressman's office was told that our case was moved to a adjudicators desk back on 5/6/08. Still nothing. The last time the congressman's office called they asked that they not call back for another month. (that will be on 7/6)

Does anyone have any other suggested steps we can take?

I don't think you have any recourse. Until they move that stupid date which won't be for another few weeks (plus 4th of July holiday) you won't likely be out of processing time. And at the rate they've been going, I won't even allow myself to hope we'll get out of August next time.

I understand and hope that for all of us that something changes soon with this process! I have a hard time just sitting back and doing nothing! I guess I will continue to work through my congressmans office and plan to contact the senators office as well. If it doesn't help me maybe it will assist others!

Unfortunately from observing for 7 months I can tell one thing, there are two type of people, people who get lucky and approved early from 1 month to 5 months,(those are people who get hard working agents working on their case)And we have those people who go past 6 months and keep delaying and delay like someone forgot about our cases.

I know that the case load is huge but, how can a file be on someones desk for that period of time?Good luck to you that things start moving for you soon!!

I think they are full of #######, look at the email I got from them from my senator.

In an effort to assist you, I have forwarded your inquiry to the U.S.C.I.S in Vermont. My office has recently received a response from their agency in regards to your case. The I-130 petition was received in their office on 12/13/07. They are presently processing petitions in this category dated 7/30/07.

The office also advised that in order for any petition to be expedited the beneficiary must have a severe medical condition that has to be treated in the U.S. The illness of the beneficiary must be documented with certified letters from doctors and hospitals. Than upon review by the USCIS, a determination would be made.

If you do not hear any response as to the status of your wife’s current petition within 90 business days contact our office.

HAHA not 3 months, 3 months worth of business days, what a ###### spit in the face.

It is totally crazy! All we want is some really good information about our cases and not the run around!

actually, best to do it over a year of filing.. =) the NOA1 date is stupid.. I filed my petition April 13, 2007, and received the NOA1 on May 29, 2007 (so I filed the I-129F on June 4, received date of June 11).. that's why they said I filed two different applications.. I followed the correct filing instructions (like everyone else here), but the local office people laughed at me while I explained how I filed.. :angry:

Is there a law stating I can request some kind of details about my case legally that they have to reply to me?

I am sick of reading we are now processing JULY 30th 2007, just sick of it

yeah, something called a FOIA request... didn't work for me, haha.. otherwise I would have gotten approved already.. even if you know why USCIS is holding your case, you can't do anything about it.. only way is to "force" them hopefully with a lawsuit..

If your kid is looking to get driver's license and misbehaves, you could threaten him that you'll make USCIS process his driving license, and he/she'll be driving when they are 60!
