I GOT SECTION 221 (g) OF INA DENIAL AT INTERVIEW

Please quickly get a House/Senate Rep involved. What this CO has done is so petty in my opinion. There are a lot of people on this site that have 221 (g) problems--there is a whole section on the forum. You can find your reps at:

www.senate.gov

www.house.gov

I recommend that you first call and make contact that way, then fax in the Constituent Services request. If you don't make that first contact person to person, it will take days more for the office to make a request for you. They need to know how time sensitive this is.

The INTENT needs to be directed to the relationship, not the location (i love u/her/him no matter where)

Absolutely...the K1 visa is granted because of the underlying relationship between the USC and the beneficiary. The resulting immigration is just that, a result of being granted this visa....showing an intent to immigrate as a hopeful reason to be granted a K1 visa will do more harm than good, as pushbrk pointed out. If it comes to light that the beneficiary tends to date only american citizens because he has a 'strong desire to immigrate' it could lead to the suspicion that the relationship was entered into for the purpose of gaining immigration benefits....i.e. a fraudulent case. Definitely not the desired result.

Unless you can get back in and speak to a more senior officer, you'll need to hire a local attorney that has experience with this Consulate. It's critical that this be dealt with while the case file is still in Ghana. If not, you are looking at a very long delay but probably eventual success.

This is exactly right! Have your cry... take a few shots of something strong (I suggest tequila ;) ) and then wipe your tears away and get back up on your feet. This is not for the weak-hearted so put on your game face and hold strong to your faith and your relationship. It's time to fight back!

Find a good immigration attorney, contact your representatives here in the States and do your very best to keep the paperwork in Ghana!

AND THE FACT THAT WHEN SHE CROSS INTERVIEWED ME AND MY FIANCE ALL OUR ANSWERS MATCH AND ALL THE EVIDENCE THAT I BROUGHT WAS TOO OVERWHELMING...TOO MUCH TO BE TRUE.

She (the CO) told you that she thought you were trying to prove something by having an overwhelming amount of evidence? The CO's are also trained to read body language and some people when they are nervous or agitated can become monotonous and robotic in answering questions...hardly a good way to prove that you love your fiancee beyond measure.

SO SHE IS SENDING THE PETITION BACK TO THE USCIS AND THEY WILL RE-INVESTIGATE AND START THE PROCESS ALL OVER AGAIN AND IF WE ARE STILL TOGETHER THEN SHE WILL BELIEVE OUR RELATIONSHIP THEN....SHE GAVE US LETTER SECTION 221(G) OF INA AND SENT US ON OUR WAY. I CRIED, I BEGGED AND SHE IGNORED.

Did the CO say she is sending the petition back to to USCIS? Was there anything additional written on your 221(g) letter....on most of these letters there are boxes that the CO can check as to the reason for the visa denial. Sometimes the 221(g) denial is just temporary because the CO will request additional pieces of evidence before making a decision as to whether to issue the visa or not...what is requested will be spelled out on this form.

If nothing else is written on the form, then this is inteed an outright denial of the visa petition and you must act quickly to stop the petition from being sent back to the states. You're still in your SO's country, keep trying to make contact with the consulate to see if you can speak to a more senior official and explain the situation, perhaps there is additional evidence or proof that you can present to convince them of the bona-fides of your relationship. Consult with and retain competent counsel there in the country, someone experienced in dealing with these types of cases....and finally involve your congressman or senator and have them make an inquiry on your behalf for further information.

Your chief intent at this point is to prevent that petition from being returned....you do not want to have to go through the additional wait.

If you are still in country keep calling the embassy until you get through and ask to speak to or better yet see a senior person. Rember to keep your temper as best you can whle talk That your fiance truely admires the US and has a strong desire immigrate , which is why he tends to date woman that are obviously ammenable to living there rather than enter into relationships that would hinder that desire.

I agree, do not mention he has a strong desire to immigrate because it will definitely made the CO think he wants to be with you for immigration benefits only. She insinuated that already by emphasizing that his ex was also American. In HER mind she feels he seeks out Americans for immigration purposes and the bolded statement would hurt your case.

Contact your senator or congressman asap. Tell them you don't have time to wait and quickly sign a release form and fax it to him so he can begin emailing and calling the embassy ( some representatives have release forms online you can print and fax or fill out online ). Give all details to him.

Contact the embassy immediatley and demand to speak to the chief consul and tell him an error was made and to review your file. If you can't get anywhere with that go to the

area that is open for Americans and talk yourself through to the chief CO. I did this and met with the chief CO after our denial.

I would recommend Mark Ellis as a lawyer , he specialises in denial based on relationship issues.

This is ridiculous, everything you have mentioned is not a reason for denial.

Hi all, please this is a very emotional time in my life so please if your reply is going to be bathering or negative please do not respond.... I am only seeking true advice from people who knows what I should do and can do and what process to take.

I was present for my fiance interview yesterday, in Ghana, and when he was called for the interview I went with him to the consulate, she asked who I was and I said the fiancee, then she asked why I was here and I said to visit and accompany my fiance. She then said good, I will do a SPLIT INTERVIEW! I said okay.

She interviews my fiance and then calls me to come for my interview and interviews me. She focused on the fact that while me and my fiance were dating back in 2006 we were both not legally divorced at the time and MOSTLY on the fact that my fiance's ex-spouse was AMERICAN and that I AM AMERICAN too.

I explained to her, that my fiance ex-spouse the american after they got married when she came to Ghana decided when she went back to America to return to her ex-boyfriend, so she stopped all communication with him and he had to wait for her to send a letter or so documentation that she did not want to be married to him anymore, so that he can take to Ghana court to get the divorce so it took time. I explained to her that me and my fiance had known each other for a long time since both our families are from Ghana and that when I had come to Ghana in 2006 and me and my fiance met is when we starting dating and that I am a BORN American citizen but that both my parents and all my family are from Ghana, my parents and everyone else are born Ghanians so my fiance family and my family know each other and when I came to ghana for the first time since I was born in America I met my fiance we started dating and then I came back to Ghana in 2007 and stayed with my fiance for over 2months and that is when he proposed and we got engaged.

I wanted our wedding in America, because all my friends, co workers, church, etc are all in America, I was born and raised here, and he will get to meet all of them. We decided to go the K-1 Visa route, and MADE SURE THAT WE WERE BOTH DIVORCED AND FREE TO MARRY BY THE TIME I FILED THE PETITION. My income is above normal, I had tons of emails from 2007 to 2008, letters in the original envelopes and cards, phone history from my cell phone over a year worth and an album full of pictures some of us kissing, some with family and us out having fun.

i am so sorry to hear your story.

i have been through the denial process myself. first you need to read the thread about denied case in the MENA forum....there is a lot of non info there but weed through it and you will learn quite a bit about returned cases.

brnidokiegurl gave some good advice. the most importnat thing is to try to get back into the consulate and see if you can prevent your case from being returned. since you filed in vermont the chances of you ever hearing from them are next to nil. the options you have if your case actually gets returned to USCIS is to refile a new K 1 or to get married and file an I-130. the CO said if you stay together then she will know you are a bona vide couple which i consider shameful.

if you have your senator/congressman on board ask them to send an e mail on your behalf. if not get a release signed so they can help you. perhaps you can have friends and family send e mails to the consulate verifing your relationship too.

how long will you be in Ghana? this is your best chance since you are there to prevent your case from being returned.

if by chance your case does get returned then we can discuss the next step.
