I GOT SECTION 221 (g) OF INA DENIAL AT INTERVIEW

Hi all, please this is a very emotional time in my life so please if your reply is going to be bathering or negative please do not respond.... I am only seeking true advice from people who knows what I should do and can do and what process to take.

I was present for my fiance interview yesterday, in Ghana, and when he was called for the interview I went with him to the consulate, she asked who I was and I said the fiancee, then she asked why I was here and I said to visit and accompany my fiance. She then said good, I will do a SPLIT INTERVIEW! I said okay.

She interviews my fiance and then calls me to come for my interview and interviews me. She focused on the fact that while me and my fiance were dating back in 2006 we were both not legally divorced at the time and MOSTLY on the fact that my fiance's ex-spouse was AMERICAN and that I AM AMERICAN too.

I explained to her, that my fiance ex-spouse the american after they got married when she came to Ghana decided when she went back to America to return to her ex-boyfriend, so she stopped all communication with him and he had to wait for her to send a letter or so documentation that she did not want to be married to him anymore, so that he can take to Ghana court to get the divorce so it took time. I explained to her that me and my fiance had known each other for a long time since both our families are from Ghana and that when I had come to Ghana in 2006 and me and my fiance met is when we starting dating and that I am a BORN American citizen but that both my parents and all my family are from Ghana, my parents and everyone else are born Ghanians so my fiance family and my family know each other and when I came to ghana for the first time since I was born in America I met my fiance we started dating and then I came back to Ghana in 2007 and stayed with my fiance for over 2months and that is when he proposed and we got engaged.

I wanted our wedding in America, because all my friends, co workers, church, etc are all in America, I was born and raised here, and he will get to meet all of them. We decided to go the K-1 Visa route, and MADE SURE THAT WE WERE BOTH DIVORCED AND FREE TO MARRY BY THE TIME I FILED THE PETITION. My income is above normal, I had tons of emails from 2007 to 2008, letters in the original envelopes and cards, phone history from my cell phone over a year worth and an album full of pictures some of us kissing, some with family and us out having fun.

Still she insisted the fact that ONE: me and my fiance started dating when we were still legally married made her suspicious, the fact that my fiance ex-spouse was American was another one and the FACT get this THE FACT THAT I WAS AT THE INTERVIEW MADE HER MORE SUSPICIOUS ALMOST AS IF WE ARE TRYING TOO HARD TO PROVE SOMETHING. AND THE FACT THAT WHEN SHE CROSS INTERVIEWED ME AND MY FIANCE ALL OUR ANSWERS MATCH AND ALL THE EVIDENCE THAT I BROUGHT WAS TOO OVERWHELMING...TOO MUCH TO BE TRUE.

I was told on VJ to bring everything except the kitchen sink, I brought every single email correspondence me and him ever had, letters in their original envelopes, phone records a year worth, pictures a whole Album from 2006 and my 2007 visit in Ghana for over 2 months with my fiance...she believes that its all too organized as if a set up.

SO SHE IS SENDING THE PETITION BACK TO THE USCIS AND THEY WILL RE-INVESTIGATE AND START THE PROCESS ALL OVER AGAIN AND IF WE ARE STILL TOGETHER THEN SHE WILL BELIEVE OUR RELATIONSHIP THEN....SHE GAVE US LETTER SECTION 221(G) OF INA AND SENT US ON OUR WAY. I CRIED, I BEGGED AND SHE IGNORED.

PLEASE LIKE I SAID BEFORE I ONLY NEED ENCOURAGING ADVICE AND WHAT STEPS TO TAKE...I AM STILL IN GHANA WITH MY FIANCE RIGHT NOW AS I WRITE...WHAT DO I DO?

TIME LINE

09/2007 - Gathered all documents for I-129F petition.

11/09/2007 - Sent I-129F

11/21/2007 - Package sent back to me( I forgot to sign one of my G-325A forms) I cried my eyes out but sent it next day delivery back to USCIS.

11/27/2007 - Received NOA1

02/13/2008 - Received NOA2

02/20/2008 - Package left NVC

02/22/2008 - Case uploaded into Ghana consulate data system

04/08/2008 - Packet 3 & 4 sent to fiance

04/16/2008 - Packet 3 & 4 received by fiance

06/24/2008 - Interview date (God blessings on this day)

06/24/2008 - DENIED visa at interview

06/25/2008 - APPROVED visa at 2nd interview with senior consulate

06/27/2008 - Picked up VISA

07/03/2008 - Fiance entered USA at JFK POE & Got EAD Stamp in passport

07/18/2008 - Married

08/07/2008 - Mailed AOS application

Telling you that you brought to much evidence and that everything looks "to good to be true" is just ridiculous...

Especially that your relationship has been going on for over 2 years...

Makes me really really sad to hear that...

There are many post here about people going through same thing... A lot of couples decide to hire a lawyer...or contact their senator... Maybe you should try that route...as soon as you can... Don't know if they send you file back to USCIS right away...but even if they did... there must be a away! I am sure! Just don't lose hope! You got nothing to hide...Make as much noise as you can about this...

Go to the press and say they rejected you fiance visa because they couldn't find anything wrong with your file...

that is absolutely ridiculous!

how can you be rejected for something like that?????????????

Hey... Just read the full story. I already sent you a PM. I gave my little piece of advice, but I trust the VJ community will provide good resources and will give you good info. It sounds like you did everything you were suppose to do and than some! I feel for you...

if indeed they are returning your intent is to keep it there. Do you have a state rep to speak for you? they can send email explaining, you can get letters from friends and family to explain the relationship but these things you have to do fast, to try and get it held there and not returned. If it gets returned to calif it will most likely be left to expire and start all over, if vermont, it just lays forever. I cant imagine saying someone was to organized and to much, usually they (not sure of your embassy) will just say oh i see you have so much no need to look at it all, maybe they will give you another appointment to speak or you can send letter for yourself also, he can do same. Again explain you did know each other before the divorces were final and the circumstances, this doesnt seem strange

Have you and your fiance 'compared notes' about what questions you and he were asked?

Do you have legal counsel in the US who has been assisting you with your petition?

If you go back to the consulate today, will they admit you?

Unless you can get back in and speak to a more senior officer, you'll need to hire a local attorney that has experience with this Consulate. It's critical that this be dealt with while the case file is still in Ghana. If not, you are looking at a very long delay but probably eventual success.

If you are still in country keep calling the embassy until you get through and ask to speak to or better yet see a senior person. Rember to keep your temper as best you can whle talking to them. Prepare a document listing the hardships that this delay will create for you so you can discuss them with whomever the let you speak to. At the same time get your congressmans office to contact the embassy. It might be easier for someone of your family here to start that and pass it off to you. You want to keep the file there if you can. Prepare a document refuting the points that were brought up for the interview. You didn't have too much evidence you brought it all with you as you were going to be there and wanted to provide whatever supporting documents asked for ( unlike faxing it is you had been here ) That your fiance truely admires the US and has a strong desire immigrate , which is why he tends to date woman that are obviously ammenable to living there rather than enter into relationships that would hinder that desire. Is there any unspoken thing that might be an underlying cause for denial religious differences , age or something like that. Cover these in your document also.

I am not sure how it could hurt. I wouldn't have started a relationship with a man that would be unwilling to immigrate. That would have been a deal breaker years ago and did factor into my dating choices. We actually want to split time between the countries but with the majority here. Then again I am not screening applications.

So sorry about this! I was at my fiance's interview - at his consulate they will deny if the fiance is not there also. He was put on AR due to name check - and that was heartbreaking after thinking we would fly home together. We were also interviewed separately - glad to hear your answers matched -- more proof of a valid relationship.

They may be suspicious if your families know each other and set this up?

Keep your level head and contact your congressperson's office.
