Takodje puno pozdrava i mnogo mnogo mnogo srece na vasem slucaju i na svim slucajevima koji su ovdje,..nista cujemo se takodje ako ista zatreba tu smo da se pomazemo i da sto prije rijesimo nase slucajeve,..ja sam sad bas dosao iz poste poslao sam AOS I-864 sa svim dokumentima,..a sutra cu poslati kompletiranu formu DS-230 takodje sa svim dokumentima,.. pa cemo vidjeti sta dalje,...fingers crossed ehhehe cujemo se caos,..!!!!

Just an FYI - the tax returns seem to be somewhat of who you get and what they want - we had all paperword sent to lawyer (yes originals) and yep got an RFE for them wanting originals lol - grrrrr- lawyer sent but if you want to fight it takes a supervisor 7-14 biz days to review so will just go and reorder all originals.

With regard to the Federal Returns, we put down two years, they want all three - but just tax transcript on last year apparently - I guess - anyways sending all to them. Just a heads up and good luck to all-

The guides state that we have to submit the last 3 years tax returns, but I've read in some posts that they are asking just for 2007. I'm taking the last 3 tax returns, I think it safer. :thumbs:

Actually the guide states that they only want the last year sent in with the I-864, the other 2 years are optional - if you think it will help to show your steady income and ability to support the immigrant then by all means you should send all three, however to state that the guide indicates you should send three years is not accurate. I think it's important to back up information such as this with links to official information. I'm not trying to be rude or anything however when information is presented as fact it can lead a lot of people down the wrong path. Please see:

(i) Documentation .

(1) Federal Tax Returns. Each sponsor must submit either a transcript or a copy of his or her most recent US. Federal individual income tax return (Form 1040, 1040A or 1040EZ), including all Schedules filed with the IRS. If the sponsor submits a copy of the tax return, he or she must also include copies of any and all IRS Forms W-2 and 1099 that reflect income used to qualify. The second note under paragraph 20.5(e)(2) provides guidance regarding what to do if a W-2 or 1099 is missing. Note, however, that it is not necessary to s ubmit the Forms W-2 or 1099 if a transcript, rather than a copy, of the tax return is submitted. State or foreign income tax returns are not acceptable; if submitted, they must be returned to the intending immigrant.

The sponsor must submit with the Form I-864 the sponsor’s U.S. Federal income tax return for the most recent tax year (that is, the completed tax year immediately preceding the date the sponsor signs the Form I-864). USCIS may generally expect a sponsor, after April 15 of any given year (or April 16 or 17, in a year in which April 15 is on a Saturday or Sunday), to have completed his or her tax return for the previous year. If the sponsor requested an extension, the sponsor should provide proof of filing fo r the extension. If the sponsor did not file a tax return, the sponsor must prove that he or she was not required to file. If a sponsor should have filed, the sponsor must file retroactively and provide proof of filing. Note that U.S. citizens generally have an obligation to file a tax return on non-U.S. earnings even if there was no tax liability.

and from the I-864 form instructions, item 25, page 8:

You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years.

Trailmix, yes, I agree in part with your opinion and I would never think you have any reason to be rude about it right? First because it won't hurt anyone to send the last 3 tax returns, that was our procedure and we were fine. Since my husband and I went through this procedure last year, long time ago, I thought that we were just following the guides, I realy was misinformed about that, only the last tax return (2007) is requested, the other ones are optional, that's what the guides say indeed. I allways read everything but tax return was his part of the procedure and I really didn't read that part and you're right we should allways send links with instructions and that was my mistake in this case, because if I did it, I would have known that properly and I apologize about that. I usually do send links with information, anyway after all I think no one would get hurt sending the 3 last tax returns or be lead to a worng path in this case, to say that in this particular information would be a exaggeration. I'm a responsible person and allways have been when sharing and posting informations here, although sometimes we pass some and it can happens to anyone. Good luck!

I totally agree with you but for us and because I am self employed although over the poverty level, they wanted all three years (and yes tax transcript was attached for 2007 to back it up)- it was part of the RFE so just maybe a req for self employed but I dont think so - think maybe we got a newbie or something - I dont know anymore lol.

When I spoke to a supervisor there, they said yes they wanted three years even though our lawyer says No - again I AGREE but what can we do but comply with their request.

Hi Susie,

Yes, that is the thing. 'Officially' you are only required to send in the last years transcript or tax return/slips - however, everyone should have all 3 years in hand when they get to NVC.

NVC's blanket instructions for all embassies and all cases just doesn't fly. For instance, for my Husband's application, two things one never would have thought of had to be sent:

1. For the I-864 I had to provide 3 years of Canadian tax returns, although the instructions specifically state - do not send foreign tax returns. (Granted the income on my I-864 was only Canadian - however we were using assets not income). I do understand their reasoning - they wanted to see that I actually have worked (was not currently working) and have reasonable earnings. That said - it's not in the instructions and who would have guessed.

2. My Husband is Australian, Canadian PR, who interviewed at Montreal. In order for him to be interviewed there he had to send a copy of his Canadian PR card - this, of course, is also not in their instructions because it doesn't apply to everyone.

I only submitted 1 U.S. tax return to NVC and it went through without a problem - however - when my Husband got to the interview in Montreal they asked to see the other 2 years, which he had on hand.

I guess the question is, how much stuff do you send to NVC that they are not requesting - does it matter? Probably not, if someone wants to send all 3 years I say go for it :lol:

Yeah go figure but will send everything to lawyer and if they want it they have it lol - I will be in the UK for two months so might as well send the vial of blood whilst I am at it.
