My fiance and I met in college, and lived together for a year after we both graduated from a four year US university. She's now back in Thailand, but has been admitted to another institution of higher learning in the USA and has a valid I-20 for entrance.

We plan to get married after she returns, while she's on student visa, and then I want her to be able to get permanent residence (green card).

Please help me find the best route for this.

03/26 NOA1 received (Priority date 03/24/08)

11/21 2nd Welcome notice received (dated 11/13)

I think it's perfectly legal to get married while in US on a student visa. She can adjust status later. But, better not to file adjustment of status too soon after marriage to avoid being accused of visa fraud.

Thanks everyone! We love each other... and that's the reason we're getting married. Not so she can become a US citizen. We want to spend our lives together, raise a family, and we've talked about this. Also, we've lived together for a long time and know each other very well. She had to go back when her OPT expired earlier this year. It's not like we have never met.

How long should we wait before getting married after she arrives in the US?

Thanks everyone! We love each other... and that's the reason we're getting married. Not so she can become a US citizen. We want to spend our lives together, raise a family, and we've talked about this. Also, we've lived together for a long time and know each other very well. Be honest. There is no "waiting period". Follow the law.

Again, marriage isn't the issue. Immigration is.

I've seen to wait at least 2 months.

However you are still "flirting with fraud" as your lady is coming with intentions of marrying and immigrating.

If caught I'm not sure of the conseguences. Not good tho.

Her intent is to study, isn't she going to be enrolled for full time study ?

I don't see any mishap with immigration if she gets married and adjust status later. People change immigration status, many F1 students got H1B after graduation and stay, some got married to USC and adjust status, don't think that's a problem.

I don't see any mishap with immigration if she gets married and adjust status later. People change immigration status, many F1 students got H1B after graduation and stay, some got married to USC and adjust status, don't think that's a problem.

She has dual intent and there are dual intent visas but F1 isn't one of them. In the present tense she plans to enter and stay/immigrate on a visa that doesn't allow it. If she were already here when she decided to marry, no problem. Intent at the time of entry is the problem. They know the legal way is with a spouse visa but are plotting to circumvent US immigration law anyway. This can result in as much as deportation and a lifetime ban. Attorney time.

It is against VJ terms of service to advise people on how to get away with visa fraud. There is no rule for how long you wait to marry. You follow the law or risk the consequences. Consult a qualified immigration attorney before she enters the USA again.
