Can someone tell me if it is a wise decision to apply for the K-3 visa two months after the I-130 was submitted? Will this delay the process or will one be approved regardless of the other?

It will be filed at the CSC.

Thanks for all replies.

Everybody wishes they could apply for a K3 visa two months after the I-130 was submitted. That would be fantazmic. I think you're asking of if it's wise to file an I-129F for spouse, two months after the I-130 is submitted. The answer depends on how well you've matched your priorities to the appropriate visa category.

Hint: Applying for a visa is the priveledge your petitioning for your foreign spouse to do after the petition is approved. The foreigner is the visa applicant. The USC is a petitioner.

In short, if working right away is important, you don't want a K3 visa. If saving a couple months time at a few hundred dollars extra cost fits your bill, then maybe you want to file that I-129F for spouse. Lots of discussion on this. Read to your heart's content.

Yes, you are correct with your terminology. However, most VJ'ers do not distinguish between the "applying" for as opposed to the "filing" in order for the beneficiary to apply. They understand the jist of it and that's ok with me.

Also, I understand the difference between the I-130 and the I-129F, my concern is whether or not filing the I-129F will delay the approval of the I-130. For example, if the I-130 were to be approved in August, would receiving the I-129F delay that approval due to combining the two petitions?

I'm asking because I've been told by a friend that it's best not to file the I-129F this late in the process because there's a good chance that it will delay the approval.

I agree with your friend but there's no way to be sure.

We get lots of questions here about who is the "applicant". If you know the correct terminology, please be kind enough to use it.

Your profile says you are pursing a K1, your signature and timers concur with your profile.

It does appear that sending the I129F delays the I130s processing. The petitions are paired, and it seems CSC goes by the notice date for the I129F for adjudication prioritization when the petitions are paired. But, as pushbrk said, you can't really be sure what will happen. Some petitions that are submitted far apart are never paired, and other anomalies happen all the time.

Good luck.

The kids wish they had just gone with the I-130, but every situation is different. No one can predict the inconsistencies of this process. They are wishing now that they could avoid AOS and the USCIS for a long time. The K-3 has apparently not speeded up their potential of being reunited sooner. YMMV. Hindsight does wonders for one's vision.

Not sure I would say that he has the problem since he was the one who was able to infer what you could not. I'm going to start questioning your age if you continue responding to these non-productive posts.

With that said....I'm done with this tangent.
