What to say regarding a Expired visa ??

There's not much you can say. Until the AOS if filed, he is out of status and deportable. No magic status was gained by the marriage.

To be precise, according to the INA, without your NOA for your I-485, even if you already did send your AOS application, your spouse may be deportable; if they decide to move forward with that.

As an aside, my wife who traveled to Dartmouth College in New Hampshire for a reunion, told me that her car was stopped, and authorities asked the occupants of the car if they were "American citizens". They all were, but what was disconcerting about the situation was, they were randomly picked, never issued a traffic summons or anything. I believe it was the State Police that set up checkpoints. The weirdest thing is... this was in NH, not a place one thinks that would have such checks.

Whatever the case, just don't lie to authorities about your status.

March 13, 2009 : Checks Cashed
March 13, 2009 : NOA 1 received on I-485, I-130, I-765. Dated March 11th, 09
March 17, 2009 : Biometrics Letter recieved (Dated 13th March). Interview on 1st week of April
April 2, 2009 : Biometrics done. Total time taken with wait 20 mins.
April 22, 2009 : Called USCIS. They have received fingerprints and work permit is in process.
May 7, 2009 : I-765 case online. Card Production ordered.
May 11,2009 : EAD card received.
May 12,2009 : Applied for SSN.
May 18,2009 : Received SS card.
June 08,2009 : Received Letter for Interview ( scheduled on July 14 th July )
July 14th : Great Interview. All done in 20 mins.
July 18th: Online status - Card Production ordered. Thank God !! I-130 online status : Pending

With today's political climate, particularly in states like Oklahoma who have passed illegal immigrant - related laws, it's a fair question to ask.

The concern is certainly valid, no doubt. I would probably have the same concerns if I were in the same boat. But the likelihood of authorities asking one's immigration status during a stop, is remote, at best somewhat rare.

The issues that I see where it can be a problem is if your spouse is driving, gets into an accident, injures someone or is detained/arrested for any sort of crime, then my concerns would be realised. One of the first things they ask you during processing is what your immigration status is at the time of your arrest. And, as mentioned, one should never lie about anything immigration related.

Perhaps it's best you filed your AOS as soon as practicable.

I guess the safe bet is to chain him to the bed and lock the door. On second thought soft ropes would save the scratches on the bed post. Marine supply stores have very nice soft ropes availble.

Really, unless you do something stupid this is a non-issue.

A slightly late reply, but I would point out that I myself had been in the country for some time with only my passport for ID, which in some cases was quite frustrating. I also overstayed, which was a source of stress as well. In the years I have been here, not once has a police officer ever asked to see my ID as I was never the person driving. While it is a possibility in some states, generally I would consider it to be a low risk unless you anticipate close police scrutiny.

I absolutely would not have left my passport at home though, risk of loss or no, it was my only solid form of ID, I carry it with me still, even though I now have my green card, and will most likely continue to keep it in my purse until I have a local driver's license in hand. To be on the safe side, keep a photo copy of the passport and any documentation supporting your AOS on hand.

You of course have to gauge your own situation as you see fit.

Feb 24th, 2008-NOA for all

March 22nd, 2008-Biometrics appointment.

March 24th, 2008-Touch on I-765

April 17th, 2008-Touch on I-485

April 30th, 2008-Card production ordered.

May 5th, 2008-Card production ordered again.

May 6th, 2008-Touch on I-765

May 8th, 2008-Approval notice sent for I-765

May 9th, 2008-Received EAD card in mail.

May 17th, 2008-Another touch on EAD (?)

May 21st, 2008-Interview date.

June 9th, 2008-Card production ordered and I-130 finally showing up online.

June 13th, 2008-Welcome letter arrived in mail.

June 18th, 2008-"Approval letter sent" email received from CRIS.

June 20th, 2008-Green card received!
