Also, for the affidavits how many do I need? Is two enough? Can they be from his mother and a friend? As for pictures is it okay to send like 5 or do they need more? Is this much evidence a requirement?

yes the affidavits should be submitted and two are enough. they can be from anyone who was present at the wedding.

Your marriage certificate is all the evidence you need that you are married. Affidavits would be in support of the relationship bona fides, not whether your marriage was legal.

You are referring to this item in the I-130.

5) Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or

It is preceded by this statement.

NOTE: In addition to the required documentation listed in1) through 4) above, you should submit one or more of the following types of documentation that may evidence that bona fides of your marriage:

Thank you for your reply. So, I will request two affidavits from his side.

Is it needed to have any from my side as well?

Also, are 10 pictures enough for the proof or do we need more?

I wasn't promoting affidavits and nobody can tell you how many pictures is enough. Pictures of what? To serve what purpose? Again bona fides evidence is about your relationship and if you read the thread I linked to, you'd see that newlyweds who have never lived in the same country, generally do not need any of this additional evidence of bona fides. Affidavits are the last thing I would include in most cases.

To illustrate my point, please give an example of what you think somebody would write about you and your spouse in one of these affidavits.

  • 1 year later...

I can see that the last discussion took place here almost 2 years ago, but apparently the rules haven't been changed. So, I am here with a question. We sent just one affidavit with the petitions, and no pictures since we thought that more information like pictures, emails, visa stamps, tickets etc would be requested at the interview. Would it be enough just one affidavit with the petition?

Enough to accomplish what? You don't need any affidavits or photos to get your petition approved. The reason for sending such evidence is to front load the case file in order to influence the Consular officer BEFORE the actual interview. That opportunity is gone, so be well prepared for the interview.

Thank you very much for the reply! I see that we missed that opportunity, but at least it's good to know that affidavits and other evidence is not influencing petition processing. I wonder if the Consular Officer is willing to go through the affidavits during the interview. I hope so. We are going to bring 3 affidavits for the interview, but I still wonder if they are going to be taken into consideration along with other evidence of the relationship?
