No, this is not an RFE, this is your NOA1 - also known as your official receipt and extension letter. Keep this letter - or a copy of it - with your expired greencard. Together they provide evidence that you are a permanent resident and your conditional permanent resident status has been extended for one year while they are processing your 10 year card. This letter is your proof for a new employer or for a renewal of your driver's license or for re-entry to the US after traveling abroad that you are legally allowed to live and work in the US.

If you did not submit evidence of your relationship with your I-751 petition, then you are requested to do so now. If you have submitted the evidence then you need do nothing more for the time being. You will receive another letter advising you of your biometrics appointment - (the ASC appointment letter) getting your fingerprints and your picture taken. When you get that letter, you will be able to check the status of your application online using the case number at the top of the biometrics letter. The case number on the NOA extension letter doesn't work for case status update.

An RFE is very clearly identified as such. It will contain a list of items and often there will be check marks against items on that list that they wish you to provide. As well, your online status should reflect that you have been sent an RFE. Since you just sent in your application, it is far too early to expect an RFE yet - your application is waiting in line with a lot of other applications waiting ahead of it for processing.

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”

Kathryne41 gave good explanations. Just want to add that NOA1 also means that you have submitted enough evidence for initial process. The recieving USBIS employee checked your file, required docs to support I-751 and accepted application for process. Later the CIS officer will check if there is enough proof to confirm bona fide marriage. If not, they will send RFE. You good to go.

  • 2 months later...

I need to fly to Manila to be with my son for his visa interview and I also have the extension letter on hand. So, there shouldn't be a problem then for me to reenter as long as I have the copy of the letter on hand?

Even my dl is expired. The Sacramento office had issued me a 30 day extension and with the budget cuts in the capitol, the woman at DMV said that there are only 2 people handling cases like mine - those people who are in between their removal of conditions and receipt of their permanent green card.

I need to get my ticket soon and am happy to see that there should be no problem for me to reenter the country :)

As long as you have your expired green card and your valid NOA extension letter - along, of course, with your passport, you should be fine. You can use your passport for photo id going through the airports. The green card and NOA will allow you back into the States. If your married name is not the same one as in your passport, remember to bring your marriage certificate as well to show the name change.

Good luck at the interview and safe travels.
