Appeals court rules for Guantanamo prisoner

do people really think all the detainees at guantamo are rightfully there? like all of them are guilty of something? hahahaha

Well, the President and the Pentagon sure don't think so. Which is why they plan on bringing charges against a whopping 10% of those detained while letting the other 90% go after years of detention for - by their own admission - no reason. Not a good ratio by any measure. It's about time this nonsense stops once and for all.

For those that were detained without real foundation... I wonder if that opens our government up to litigation????? Imagine that... a REAL threat to the US.

I could be wrong but I thought there was a previous ruling on that.

I could be wrong but I thought there was a previous ruling on that.

Can't be sure... still... several years in the pen for no apparent reason other than the suspicions of a foreign government that snatches you up in your country or in a third country... kind of a clear-cut case of overstepping oneself there. I wonder if at release they get some sort of apology. Probably not.

There was a test case - not in relation to Guantanamo, but that guy Khalid Al-Masri who was wrongly arrested and sent to prison in Afghanistan via the CIA policy of Extraordinary Rendition. There have been several court rulings on that in various Federal courts (including the Supreme Court) all of which have been denied - which seems to suggest that in cases such as this, the Government and CIA are above the law.

Of course. I assume its all about a government acting in good faith with the "information it has at the moment" to detain potential threats. Meanwhile human rights go out the window as do our sensitivities to these kinds of actions based on "information known" at any particular moment.

Its weird - given that its pretty common for damages to be paid out for a USC falsely imprisoned in a US jail. It seems the same does not apply to foreign citizens arrested overseas and incarcerated in legal loophole facilities - by agencies that have a certain degree of legal immunity.

What it would seem to come down to - is noone wanting to take responsibility for a mistake, because doing so could endanger a policy that is deemed "necessary" and "vital".
