Hi,

I have a question about the DS-156K regarding the 'evidence of financial support'.

Assuming the K1 is granted, I will have a little money of my own but very little. I am fortunate in that my fiancee has a great job and would be more than capable of supporting me for a few months. Is that 'acceptable' evidence?

I have a few things in my favor. Firstly I have been a consultant/contractor so assuming I get my temporary EAD through JFK I could possibly get a short contracting engagement in project management/business analysis - I've got many years experience in Hi-Tech manufacturing systems as well. Also I am a 'qualified' photographer and by that I mean I am a member of a professional body so hope to start a photo biz. Could all this be considered enough?

We're going to be living in Arizona, Gilbert Az to be exact so there is some tech business and a few other options....

The evidence of financial support would include the I-134 and supporting docs (letter of employment, tax returns, paystubs, etc. As long as your fiance meets the poverty guidelines you should be fine.

Evidence of financial support is an I-134 and financial evidence provided to you by US citizen petitioner/sponsor.

One thing about I-134, the directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

  • I-134 signed and notarized.

  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html

  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

I agree with everything said! I had my interview nearly a month ago and I too need to be supported by my fiance until I'm able to obtain employment.

I submitted:

1. I-134 - Affadavit of Support

2. My fiance's pay stubs

3. Letter from his employer confirming his employment

4. Tax returns

We didn't get the 1-134 notarised so, although the visa was approved, it's been withheld until I send the notarised document along with my passport to the embassy. This I've done and now awaiting my visa package.

I've seemed many fiance(e) got deny visa due to lack of this form, I-134 (Affidavit of support), and DS-156K specifically mentioned it. US Embassy will ask for this financial support (w-2, paystub, company letter and bank notarized), etc. I believe K1 visa will never be granted until you provide these proof to the US Embassy. If they give you K1 visa, then you have nothing to worry about it.

My visa was not 'denied' - I had approval pending an extra signature and stamp on my support document (ie a notary).

I guess my next question would be do I provide a notarized copy of my fiancee's 1-134 and supporting documentation that she submitted for the 1-129 petition process?
