HI I AM NEW MEMBER TO VJ.I AM RESHMA DIVORCED FROM MY ABUSIVE HUBBY VIJAY.I JUST GOT DIVORCED FROM HIM AND I NEED TO TARVEL TO INDIA URGENTLY AS MY MOM IS VERY ILL.CAN I GO TO INDIA AND COME NACK N FILE MY 751.MY GC EXPIRES ON SEPT 22, 2008 IE MY CONDITIONAL GC.Please guide me i am extremely worried, have jo job no income and did not get any alimony from my ex.pls reply asap.god blesss u all!

Your current greencard is valid until expiry.... You will continue to have all the benefits associated with it until such time.

You can file the I-751 with waiver of joint filing NOW, if you have record of divorce, you do not need to wait until you are within the 90 days of CR-Green-card expiration.

2. Filing with a request that the joint filing requirement be waived. You may file this petition at any time after you are granted conditional resident status and before you are removed.

If you are filing to waive the joint filing requirement because your marriage has been terminated, also submit a copy of the divorce decree or other document terminating or annulling the marriage with your petition.

You can travel with the card but will need to return to the USA before it expires, or if you have I-751 receipt letter, then the green-card can expire, the letter will extend it for 1 year.
