Poverty Guidlines

I understand the poverty guidelines are established by the size of current household plus the immigrant and any kids they bring. How does it work when you have a co-sponsor?

My mother will be the co-sponsor, she has no one else in her household she supports, so how is household size figured here? Myself, my two children, my fiance, and my mother for a total of 5 and income level $31,000? Or is it just herself and my fiance she has to support?

Also, her actual working income is about $500 shy of the needed lvl assuming it's a household of 5 that needs to be figured. However, she recieves an additional $750 a month in spousal support from my father out of his military pension. Is this countable income? If not, I'm assuming I will need to find a 2nd co-sponsor, but reading that has totally confused me on how they figure who supports which family members.

Here comes that migraine again!!

If you will download the I-864 Affidavit of Support, which is the form used to adjust status, it gives alot more information in the instructions about sponsors, who is considered in the household, etc. The I-134 should basically fall under the same rules and instructions, but is a shorter version of a support affidavit. Once you get the visa and marry, then you will be doing the I-864.

Assuming only your fiance is immigrating, and your mother doesn't support you, your mother's household size would be two. If the $750 is court ordered, it can be included.

Facts are cheap...knowing how to use them is precious...
