Hi guys,

I've read through LOTS of posts on this forum and read many documents and stuff but I'm a little confused:

I will be entering the USA through JFK and would really like to be able to work as we need the extra income.

Now from what I understand; when entering through JFK [whether you ask for it or not] they give you a "stamp" that allows you to work.

Now this stamp is clearly NOT a document... it's a stamp. So is this different to the actual EAD?

If so; then do you still need to pay the $340 fee?

If you look on the I-9 form it puts this as DIFFERENT to the EAD:

4. An unexpired Employment Authorization Document that contains a photograph (Form I-766, I-688, I-688A, I-688B)

5. An unexpired foreign passport with an unexpired Arrival-Departure Record, Form I-94, bearing the same name as the passport and containing an endorsement of the alien's nonimmigrant status, if that status authorizes the alien to work for the employer

If it really IS different; then do you even NEED to fill out the form (as short as it is) or pay the fee?

Any help from someone who has actually received the stamp from JFK and has been through this process would be greatly appreciated :blush:

The temporary stamp only lasts till the i-94 expires, you still need to apply for ead also.

Once the stamp expires you may have to stop work till you recieve your Ead.

Thank you for your help, but even though it is limited to 90 days, I'll be getting married pretty quickly after entering the State's and filing for AOS, green card, longer EAD and all that jazz, but my questions are;

can I work on the stamp?

do i have to PAY for the stamp?

Do i need to hand in document I-765 in order to get the stamp?

I've heard people say that they just automatically received the stamp upon entrance.

This would suggest that there is not additional paperwork or fee involved.

Is this the case? :huh:

I haven't heard of anyone just getting it stamped, you have to ask for it. Once you AOS, the fee is included for the EAD.

There are other places I've heard it as well and on other websites, but I sometimes hear conflicting information;

Some people suggest they pay, several say it's free, many say they receive the stamp automatically... but no-one mentions the additional paperwork; so I'm wondering if the additional paperwork is required...? (also, is there a fee or not?)

EAD info

Please refer to the above link. It has more info than you can shake a stick at regarding the EAD process. Some good some not so good, none of it bad info. You should decide for yourself which way you shold go with the info. Unfortunately USCIS and SSA do not seem to communicate with each other and possibly within their own ranks. Their printed guidelines serve no functional purpose other than to further confuse us.

p.s. My wife got her visa and I-94 stamped but not with the famous "JFK" stamp. We went to SSA and they gave her a card and she is working. I have printed out all statutes and official information from both SSA and USCIS and footnoted the confusing and conflicting information. Should DHS have a problem with her working I am prepared to present my case as to why and how she became employed.

Calling an illegal alien an "undocumented immigrant" is like calling a drug dealer an "unlicensedregistered pharmacist". (because somebody gives a damn)

Hi All,

It's been a while but here goes the 411 on EAD!!!!

My now husband but former fiance Dan, got here on Feb 12th. We were freaked out about the whole JFK EAD stamp thing because we thought he needed it. YOU DON'T NEED IT TO WORK. We stressed for nothing. We eventually were able to confirm with USCIS as well as social security office. They issued him a ss# right away and they told him he could work up to 90 days on his K-1Visa. They looked him up in there computer system and said all his info was there, and that sometimes it takes a week for the permission ####### to show but that his was all there and he was good for 90 days.

So he got a job right away and started working. We had no problems. Than he got offered a better paying higher job, only problem was that the start date was when his 90 would expire. We got married applied for EAD and advance parole travel docs and AOS etc...

When we learned how long it could take we called USCIS. We asked for expedited the EAD and travel doc part, not the AOS. We got approved in 2 WEEKS for both!!!!!! He now has a 1 year EAD, started his new job on May 12th and all is well.

So please, if this helps anyone, do not stress, but do apply for your regular EAD asap as it can take about 60-90 days. Since Dan had the job offer that would not wait for him, they expedited his and he got it in 2 weeks but basically you are good the first 90 days with ss card and than with reg. EAD. Apply when you do your AOS and it is included in that fee you pay so do not pay an extra fee for a temporary one, and please don't re route plane flights to JFK, its just not needed!

July 24, 2007 packet received and signed for

August 2007 received NOA1 with receipt date of July 31, 2007

Dec 10, 2007 received email notification that NOA2 approval notice has been sent and petition approved!!!!!!!!!

Dec 14, 2007 received hard copy NOA2 approval in the mail

Dec 14, 2007 called NVC said our case had been received and already sent to the New Zealand consulate in Aukland!!!! Whoohoo!!!

Dec 24, 2007 Fiance received packet #3 from Auckland Consulate WOOOOHOOOOOO!!! Merry Christmas to us!!!

Dec 29, 2007 Fiance completed packet 3 and sent to Consulate.

January 2, 2008? (checking the date) Consualte received packet 3 back

January 3, 2008 Medical

January 7, 2008 Inoculations

January 8, 2008 Received letter with interview date from Consulate!!

Jan 31, 2008 Interview scheduled

That sounds weird. When you get an SS card and have no work stamp in your passport it´s just a restricted SS card and it´s not really meant for working purposes. :unsure:

That's not true! The ss is authorized, the authorization shows in the computer system at ss. We tripple checked and the lady said the system tells her he is allowed on K visa to legally work for 90 days and than he would need to have the reg. EAD. Uscis said the same thing when we called the help line and than repeated it when we asked about expediting the reg. EAD for the new job. This has been our experience and we have talked to several people on it.

That was my impression of the system. They have brought some parts up to date but other areas are still lacking. When questioned about this they freak out and say that their system is perfect and no mistakes exist but the evidence strongly suggests otherwise. Both the SSA and USCIS insist that they depend on the SAVE system and that is where it says that the K1 is authorized to work.

I telephoned JFK Immigrations last night and spoke with an Inspector first then the Supervisor on Duty and was told that they very rarely give out the one line EAD stamp anymore (apparently it is a couple of old-timers who are in the habit of it) they confirmed that USCIS has made the stamp obsolete and that a K1 with properly submitted paperwork is authorized to work for 90 days provided they get their SS card. They could not speak to whether or not JFK was the only POE that would give the stamp but did insist that a K1 did not need it. Granted JFK is not the final decision makers on this subject but it does shed some light on the rumor that 1) they were using the stamp and 2) that the stamp is no longer officially recognized by USCIS as an EAD, instead the S.A.V.E. system is their source of information of work authorization.

It would be great if they would get it together and clarify their proceedures so that all the rules jived with each other. I'm not holding my breath...

Ok cool. Well even if I knew it back then my work permitted period wouldn´t be 90 days but only like half of it. When I went to SS after 2 weeks of being here they said I had to wait 30 days after entering USA to apply for SS card. Plus after that like 2 weeks to receive the card. So like a month and a half left to expiration of I-94. That isn´t even worth bothering :wacko:
