Can we still apply for K1 visa in this case?

Hello All,

I would like to know one thing about applying for K1 visa.

We are getting all papers together for applying K1 visa right now.

and my BF told me that he might have to go overseas for his job next Dec or Jan.

It is not sure yet but in that case, can we still apply K1 visa?

I was wondered how its going to work?

If he lives in US when we submit papers, we still can process it and get married?

Please advice!!

Your "fiance" can file a petition for you which when approved, will allow you to apply for a visa. (How does your fiance feel about you having a boyfriend?) :devil:

However, the terms of the K1 visa require you to marry in the USA within 90 days of entry with the intent of remaining in the USA as a permanent resident. You don't mention how long the overseas assigment is anticipated to last but you would need to remain in the USA for at least three months after the wedding to get advance parole and both of likely return for an interview to adjust your status to permanent resident.

Google "maintaining permanent resident status" to see the rules on that.

It may be more practical for you to marry abroad and then take the spouse visa route when he's ready to return to the USA on a permanent basis.
