My husband and I married a couple of years ago and adjusted my status shortly thereafter. I received my conditional GC on 11/20/06 and will apply to remove conditions early in the 90-day window (I'm thinking 8/25/08 or thereabouts). My question is what happens if I don't get my permanent GC by 11/20/08 when my conditional GC expires? Do they allow us to extend the conditional GC for some more time? Can I continue to work in the interim or do I need to file a new EAD? What about traveling abroad? Do I have pay extra for any of this (i.e., beyond paying for the I-751 and biometrics)?

Another quick question: they don't need an affidavit of support again, right? We will be showing all our joint financial documents as proof of our being together, but we don't need to show that my husband makes enough money to support me etc., right?

Thanks for all your help.

Your Notice of Action for the I-751 (NOA1) serves as a document of proof of extension of your permanent resident status while your I-751 is being adjudicated (up to 1 year). This, along with the expired conditional green card, is proof that you can work and travel (no EAD or AP needed). If you don't receive the extension letter, you can make an infopass appointment to request an I-551 stamp in your passport which also serves the purpose of extending your PR status.

No affidavit of support is needed for the I-751.

Thanks. That's very helpful. I hope that the extension will also allow me to extend my driver's license, which also expires 11/20.

It should. Some states are a little worse than others to accept the extension letter but they seem to be getting the message now that this document is a legitimate USCIS document that does extend status. If, for some reason, your State DMV does not want to honour the NOA extension letter, you can always ask your local USCIS to put the I-551 stamp in your passport, which they generally do recognize.

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”
