Guys,

Please help me. We started our journey filing the I-130....got that approved. Then filed the I-129 as told and got that approved as well.

Then our I-129 was sent to my local consulate, and I'll have my interview on June 30th, and will hopefully be approved.

Thing is, my husband also received the letter for paying the $70-00 fee and I the letter to submit a DS230, choice of agent form, which we did.

Question is........My 13 year old daughter was included in my K-3 Visa..........will she automatically be included in the IR1 as well?

My husband filed only a I-130 for me when we started on the K-3 journey.

Is there anybody who went through this as well?

Thank you

No, your daughter isn't included in any way on your I-130 or the CR1 visa. Actually, your daughter isn't included in your K3 either. She has derivitive status and can receive a K4 visa based on your approved I-129F. There's no point in you pursuing a CR1 visa or paying the $70 fee because you didn't file an I-130 for your daughter. That could have been filed concurrent with your own, now or later with the adjustment of status.

Stick to the K3/K4 path.
