I just recently got married to my wife in China and am curious about the IR-1/CR-1 for her and her daughter who is 16. Do i have to file an I-130 for both of them seperatly or just one? If anyone can give me any advice i would very much appreciate it.

You have to file an I-130 for each of them ( 1 for your wife and 1 for your step-daughter) but file both petitions at the same time. you can got to the USCIS website and there you can find out which service centre your state is covered by.

If you want to do CR-1 CR-2 for wife and daughter then you file an I-130 for wife and another I-130 for daughter, they are two visa petitions.

If K-3/4, then only an I-130 is needed for wife, and you can file I-130 for daughter later when adjusting status. K-4 is issued as a derivative of the K-3. CR-1 does not have derivative visas for children.

Note: Marriage needs to be before step daughter's 18th birthday.

3. A stepparent or stepchild, if the marriage that created the relationship took place after the child's 18th birthday.

Not correct, the OP is asking about CR-1 and CR-2 for child, this is different than K-3. CR-1/2 require separate I-130s for each visa.

K-3/4 can do one for parent, and later has to file another I-130 for the child when adjusting status.

Correct but even in the K3/K4 scenario I would advise filing both I-130 petitions together. It keeps both CF1/2 and K3/4 options open and the two AOS cases together.

All in all, I would recommend just filing the I-130's for the CR1/2 visas. It will take a bit longer to reunite your family but cost significantly less in money and hassle.

Thank you all for the useful information. My wife is currently getting all of hers and her daughter's paperwork translated by the notary and then sending it to me. I think that i am going to file the CR1/CR2. I am hoping that it will not take longer then a year, but if it does we can wait.
