poverty guidelines. what does it mean exactly?

Howdy all!

I am a little ahead of myself as we will be resending our 1-129f forms off in a few weeks (the first ones got sent back due to our incompetence with the G325's forms etc) Anyway, I was looking over posts about poverty guidelines and am totally confused about ratios and percentages etc, so wondered if anyone could simplify it for me.

The poverty guide line for household of 2 (that would be my partner and I) is $17,500. Is that how much he has to earn in a year? or does he need more? If so, exactly how much does his income have to be a year? (this will be for the upcoming 1-134 form and later the 1-864(?) one?). Many thanks in advance for any help!

03/15/2012 -Received letter from USCIS - have to go to interview April 24th

04/24/2012 - Interview and ROC approved!!

05/07/2012 - Received email, card production ordered

05/11/2012 - Green card arrived

N-400

06/22/2012 - Mailed N-400 package to Phoenix/AZ Lockbox

06/26/2012 - NOA date

06/28/2012 - Check cashed

06/29/2012 - NOA arrived in the mail

07/02/2012 - Biometrics appointment letter arrived in mail

07/19/2012 - Biometrics appointment

07/30/2012 - Received text +email. Application placed in line for interview

07/30/2012 - Received text +email in evening - interview letter sent

True but it does not indicate that meeting those published requirements will satisfy the Consular Officer at interview, as to the public charge concerns. I've seen people with income above but near the guidelines asked to obtain a co-sponsor. As such, I advise those who barely meet the guidelines and can do so to have a co-sponsor's I-134 and supporting information available, if needed.

One of the biggest mistakes we see here is people thinking the visa/immigration process has some objective formula or set of criteria with which compliance assures success. A large part of the process is determined by the subjective judgments of what are often some pretty unintelligent humans.

Facts are cheap...knowing how to use them is precious...

I've emboldened the portion of your post that bothers me a little.

This is a consulate specific issue. The best way to determine how your consulate views the financials is to research the consulate itself.

Some consulates have weirdo takes on the financials, such as New Delhi which REQUIRES three years of tax returns. Some consulates don't require the I134 and just want to see personal financial documents of the sponsor. Things of this nature are consulate policy.

I don't think most beneficiaries need to carry an co-sponsor affidavit if they meet the criteria but are 'borderline'. Not unless there is anecdotal evidence of their consulate using the financials as an 'excuse' to deny - which they can always do under totality of circumstance.

China is a whole different ball game than NZ. ;)

co-sponsor is not an issue in NZ if you meet the requirements. They also require just one year of tax transcripts and do ask for the beneficiary's CV/Resume and proof of funds as well.

Chris, I sent you the response from the Embassy that I received. Hopefully that will help prepare you. ;)

Yes, I should have said "usually advise" because actually I think most are wise to do so. Most of the people I advise have beneficiaries coming from countries where this is important. As you know, the high numbers do come from the more difficult or high fraud countries.

Yes, I should have said "usually advise" because actually I think most are wise to do so. Most of the people I advise have beneficiaries coming from countries where this is important. As you know, the high numbers do come from the more difficult or high fraud countries.

Newer members don't realize the consular differences. You post a lot and usually accurately :P Just remember when 'they' are reading you, 'they' could be from anywhere.
