oops...never mind. I forgot you were waiting at CSC and not for the visa!

The 129 will give him a K-3 visa which will allow him mulitple entries, but no authorization to work or get a social security number until you apply for the EAD. I just hope the interview and checks at the consualte go quickly.

Ok I'm a little confussed here. So when my hubby enters on the K3 visa he won't be able to work right away? Does that mean that he won't be able to apply for an SSN straight away or do we have to wait? I thought he was going to be issued some type of work permit upon entering that he could use till the AOS was complete.

With a K-3 he will have to apply for the EAD before he can work. He will be able to apply for the eAD without applying for AOS right away. The social security card can not be obtan until he has the EAD.

The k-1 (fiance visa) does allow for a social security card upon entry and a 3 month work authorization, so that might be what you are thinking of?

Filing for AOS now automactically includes the fees for the EAD and the AP (for travel). the new cost is $1,010 which includes the biometrics fee.

On a K-3 you can file only for the EAD ($340) which should take 2-3 months to process and file for AOS later if money is a problem. AOS will still be $1,010 even if y ou already have the EAD card.

YES THAT HELPS ME HEAPS!!! Thanks so much for clarifying =0). One more thing will applying for AOS affect his 2 year multiple entry visa? Would we be allowed to go on vacation out of the states during the AOS, and if so is there a time limit that he is allowed to be traveling? Or do we have to stay put untill his AOS is complete?

Fantastic news! I remember watching your case for ages...glad to see it finally came. Still waiting for gogo and a few others! :dance:

By the way, you can check our AOS timeline to get a little bit of an idea what to expect. We filed for EAD, SSN, etc. as soon as we were able to.

I hope someone who has traveled on the K-3 will come along and clarify better than I can, but the way I understand it is the K-3 multiple entry is allowed even if AOS has been filed. I think the AP (for travel) is for those who have a single entry visa and need to leave the country while waiting for the status to adjust. BUT do double check that!!!!!

AFTER A LITTLE OVER 2 YEARS OF WAITING WE FINALLY GOT A LETTER IN SNAIL MAIL THAT OUR i129f HAS FINALY BEEN APPROVED AND BEEN SENT TO THE NVC. THANKS TO EVERY ONE WHO HAS BEEN HERE TO OFFER SUPPORT ALL THIS TIME!!!! This was totally unexpected. Right when all hopes were lost we got news. Its been a long and painful 2 years but hopefully now things will get moving for us. Our I129F is the one that got approved. The I130 was sent to the local Houston office back in Jan and we have not heard any thing regarding that petition since. Now since the process has completely changed since we filed I want to know what happens next. Where do we go from here, what should we do? I got an email from the lawyer also saying that our I129F was approved and that some further paper work was going to be needed to be sumbitted is this true?. Can the paper work be done by us or do we really need the services of the lawyer to keep the I129F going?
