Timeline

Hey all we filed in November for the adjustment of staus and today June 20th we receieved a notice that our case was denied just wondering if anyone could possible help me in what do do next they say my Husband has to go back on or before july 12th...any comments in what to do???

04/26/2007---Check cashed

04/27/2007---recieved NOA1

05/22/2007---e-mail NOA2

05/25/2007--hard copy NOA2

06/01/2007--He recieved Pack 3

06/05/2007---sent back pack 3 to embassy of amsterdam

06/10/2007---broke my arm...no trip for me

06/20/07---recieved pack 4

07/05/2007---new trip booked cant wait

07/24/2007--- Medical interview

08/06/07---interview date

****INTERVIEW PASSED****

08/09/07---Martijn will enter the USA

10/12/2007---- We will be married

11/07/2007----sent in the I-485

11/16/2007---uscis received I-485

02/05/2008---rfe

02/31/2008-- sent back rfe

06/20/2008----denied for I-485

06/24/2008---meeting with immagration lawyer

What was the reason for denial?

It is possible a competant immigration attorney is needed.

they said in the letter that i failed to show that our joint sponor was a u.s citizen thats all it says

they said in the letter that i failed to show that our joint sponor was a u.s citizen thats all it says

So the did not accept the I-864... The response sounds harsh... Are you sure there was not a missed RFE that was not responded to?

Maybe make an INFOPASS appointment pronto to discuss too..

Are you sure the RFE reply was recieved for processing by the USCIS?

Was there any doubt in the information you provided in the response that the joint sponsor was not a USC? How did you prove they were a USC?

yes we reveieved a notice that our rfe was receieved and our case was resummed..I guess i just figured that they would know that our sponor was indeed a us citizen i didnt relaize i had to prove it...we now have a appointment with a immagration lawyer on tuesday and she seems to think that we really have nothing to worry about

I-864 states that you have to provide proof of US Citizenship or LPR status of a joint sponsor. Now that the case has been denied I am not sure if an infopass would do any good. Your immigration lawyer will be able to advise on your options.

just being curious...if a denial case like this, would they just have to fill out and submit the documents again without paying the same AOS amount?

Nope... You pay an application fee... an apparent decision was made on the application... If you submit a new application, then a new fee is required...

To prove that the co sponsor is US citizen you have to submit his birth certificate or copy of his passport page.

According to the instructions on the I-864 the sponsor or co-sponsor can be either a US citizen or permanent resident.

A joint sponsor can be any U.S. citizen, U.S. national, orlawful permanent resident who is at least 18 years old,domiciled in the United States, or its territories or possessions,and willing to be held jointly liable with the petitioner for thesupport of the intending immigrant. A joint sponsor does nothave to be related to the petitioning sponsor or the intendingimmigrant.

What was your RFE for, if not for proof that the joint sponsor was indeed a US citizen? If your RFE was for something other than the reason for your denial (failure to prove citizenship of co-sponsor) may I ask, did you include any evidence as to the identity of the person who was your co-sponsor?

Proof of U.S. citizen, national, or permanent resident status isrequired for joint and substitute sponsors and for relatives ofemployment-based immigrants who file this form.
