I'm looking ahead to August when we can file AOS. On the I 485 in Part 3 Section A the last question is "have you ever before applied for PR status in the US?"

I realize that should be a straightforward question but here is my confusion. I have searched the guides and read the section in the NOLO book. Patrick came to the US when he was 15 as a dependent of his dad. I think it as an E visa, Inter-company transfer...Anyway, he didn't get a green card until he was 18, due to the stipulations of his visa. When we applied for the K1 we included the copies of his surrendered card (from his return to Germany) and his A# etc. I assume that this means, yes, he did apply for permanent resident status before. Do I just include the same green card info as before here?

Also on the I 765 it says "have you ever applied for the right to work in the US" (or something similar...question 11). He was given the ability to work when he received his former green card at age 18 but he never worked. His SS card says "ineligible for work without DHS authorization." But he never applied for EAD specifically.

Am I making this too difficult?

Yes, just answer the questions and do not read more into them...

Did he ever apply for PR status? YES

Secondly, the question is not "Did you ever work?" There is more than just the EAD card that gives authorization to work. Another type is a greencard...

Did he ever apply for the right to work? YES

That's what I thought, but then I started second guessing myself. Funny I wasn't this crazy when filling out the K1 stuff.

Wait. Maybe I was.
