Curious about RFE's

I have yet to receive an RFE during any point of the immigration process and am just about to file my I-751 to VSC. Just curious, if you receive an RFE, do they tell you specifically what documents they require or do they leave it up to you to figure out what additional primary evidence would help your petition?

I think some people get a general RFE (similar to the list on I-751 instructions), some get more specific demand (like prove of shared residence). CIS is looking for apartment leases, mortgages and financial info (taxes are must). This is from other people posts on this forum.

Will i got RFE on march , it was list of different evidence, i decade to sent all the items on list for the safety side.

but they did nt tell you exactly what u need. i didnt add any new evidence i just send same evidence again , i know it stupid

but they accepted and approved my GC. just don't worry to much like me, take it easy.lol.

I hope all the luck for you ,and never get RFE cause it sucks.

If you get an RFE, they are usually pretty specific on what they are looking for. From what I have seen in the year + I have been reading this particular forum, 95% of RFE's are looking for more evidence of co-mingling of assets and liabilities -- basically showing you have been merging your finances, and they usually tell you what they want to see.

I just got my first RFE in this whole immigration drama and I have to say that I hit me hard! I know I shouldn't sweat it, since I haven't even spoken to USCIS (I got the letter an hour ago and USCIS is closed right now) but I just don't know what they could possibly want! I sent our mortgage agreement, taxes for the past 3 years, medical insurance, house insurance, cars' insurance, bank statements etc... All joint. Aren't these the most important documents they are looking for? And that's not "sufficient enough"? What is then? That's ridiculous. We've been happily married for 3 years... What a beautiful gift for our 3rd wedding anniversary (on Monday). What do you think I should send? Pictures? All this stuff all over again? I just don't get it.... Can somebody please help?

Wow, sorry dude, you seem to have sent in similar stuff to me (in fact we don't even have a mortgage, we rent, and I got a letter from our landlord saying that I live there because we didn't want to get a new lease, ie increase in rent).

Did you send in any joint bills (or bills of any sort even if you one name on them), eg phone, cable, electricity, gas etc? Does your letter specifically state financial evidence or other things as well? Did you, for example, send in any affidavits or photos? Car titles?

I just sent my package in a few days ago, and I'm also nervously waiting to see what happens. We didn't have any joint liabilities (ie in both names) for example, except things like car insurance. My wife has a couple of student loans and about 3 credit cards (almost 2 now!) from before our relationship so there was no way I was going to have us signing up for anything else until those have sufficiently been paid off. I don't believe in borrowing money unless absolutely necessary so we haven't taken out any sort of loans.

Being that I'm not currently in your situation (and hopefully I can skip the stress of an RFE), its probably easy for me to say, just relax, take a deep breath and think it over for a couple of days. I'm sure you and some others on this board will generate some ideas, and this'll just be a little annoyance. The process seems to be completely random, and unfortunately we all suffer a little.

Your list of evidence looks good. The only thing that comes immediately to mind is that maybe you didn't send in bank statements and insurance statements that covered the whole three year period of your marriage? You could add more statements and perhaps some utility bills from different stages of your marriage, maybe 3 or 4 examples of each from each year. The other option is that somehow the information got separated or misplaced from your file and you did everything right but they lost it. I would send in more of the same but in greater quantity and perhaps add something like your wills, etc.

Don't let it get to you too much, just gather the information up and resubmit it as soon as you can so you don't miss their deadline - then enjoy your Happy Anniversary.

I think they loose our documents and that is why people get the RFE.

Maybe you have sent it but have not mentioned here... But looks like you showed that you have co-migled finances. Have you sent any pictures, letters from family/friends, travel bookings-to show that social life was comigled too?

And these financial docs you have sent-do they show all addresses and time span? Some people on this forum mentioned that they have just re-sent the same package and were approved a few months later. So, maybe they just have a quota for RFE???

I think they just lost the documents,and they want you to sent it again,on my experience , i got RFE cause i didn't send the 2007 taxes but all the documents was there, so i sent same evidence with 2007 taxes,than after week they approved.

Just relax, i think they just try to delay the process .

I didn't include any photos, I figured things like taxes or mortgage are more important than pictures. But maybe I was wrong. I'll send pictures. I'll also send more docs covering the last 3 years... I don't know what to do about the utility bills though. I think all our bills are either in mine or my husbands name... I think USCIS should get real with that. A lot of companies won't even let you add a second name. How did you guys go around that? I looked at my house warranty (is that the deed?!) and it says something like "(my husband's name) and (my name), husband and wife, occupying the property at (address)". That shows joint residence right? I'm also going to ask my parents in law and friends to write letters... I really can't think of anything else... Many people I talked to (including USCIS 800 number) said the docs might have gotten lost (nice). So I'll just resend everything plus some more. Thanks again to everyone that responded!

We didn't get a RFE, I as the US citizen elected to write the cover letter and we filed the I-751 jointly. Always try to do a business letter on one page. This is a copy of the proof section.

1. Jointly completed I-751 Form

2. Copies of I-797C "Welcoming" and permanent resident cards for Gloria and Jessica.

3. Copy of Nicholas, Gloria, and Jessica's current WI drivers licenses.

4. Four letters written by U.S. citizen friends and relatives, attesting to our relationship and marriage.

5. Joint ownership of our home deed and two of our five vehicles

6. Copies of our mutual health and automotive insurance policies.

7. Copies of our federal and state income taxes for 2005 and 2006. We were married October 12, 2004.

8. Copies of our banks showing joint checking, savings, and CD accounts.

We also included photos, but we didn't list them, I also tossed in a copy of my photo ID veterans card like anyone gives a damn I sacrificed six years for my country. At the advice of a friend that went through this with all of her evidence lost by the USCIS, when I fired up my copier, made two identical stacks, but sent in the original affidavits to the USCIS and kept the copies in an envelop just in case. But when you do that extra work, they don't lose them, if I didn't would be scrambling all over trying to recompile that stack

Did a color copy of our three driver's license's hoping it would ring a bell with the USCIS, they just don't give these things away without plenty of proof of residence. It worked, just took forever to get those cards and we just got them a month after applying for the N-400.

What a number of people have done is to include some of the utility bills listing the US spouse's name and some of the utility bills listing the non-US spouse's name as they show both of them paying for utilities at the same address - verifying address plus co-mingling of financial responsibilities at the same time. As all of the utility bills are in my husband's name we didn't include any either, hoever we did include a lot of other evidence. Why not give that a try? And yes, losing documents seems to be a very common occurence with USCIS.
