Timeline

Question: My husband came over on a k-1 visa, we were married within the 90 days....We filed for the change of status (AOS and EAD)...And have the biometrics appointment on July 11, 2008...

Today he received a learner's permit to drive and the expiration date is 8/16/2008 - the date on his

I-94 (the deadline for getting married)....How can he renew his learner's permit without the green card?? The green card won't be available for about 9 months...Is there anyway around having the permit expire in 2 months??

You need to ask the State as each State is different... Some states accept the EAD card, some will accept AP as proof, some will even accept the I-797 NOA as proof....

BTW, who said 9 months for a greencard?

You need to ask the State as each State is different... Some states accept the EAD card, some will accept AP as proof, some will even accept the I-797 NOA as proof....

BTW, who said 9 months for a greencard?

That is the estimated time for North Carolina given by a local immigration attorney.

I'm in NC too. You can't get an NCDL without a SSN. When I got my EAC, I went to the SS office and applied for a SS number. When I got my SS card, I took both the EAC and the SS card to the DMV, and got my NCDL with those. However, the license has a restriction on the back, saying that it is only valid as long as my EAC is valid. I was told that once I get my greencard, to come back in and they will give me a new DL with the EAC restriction removed.

Now I await the arrival of said greencard :D

In New York, it shows your temporary status as the day your ID (EAD) expires. However, it is just a restriction, the permit is still good for 5 years. They remove the restriction once you get the greencard.

He's gotten a SSN and took the card when he got the driver's permit...What is an EAC? Sounds like he can get the permit extended to get the license with that document? thanks!!

i'm in MN...i did my test for my DL @ the end of May & and then i went back up to the counter after passing it...the lady tells me that i will likely get my driver's license within 4-6 weeks in the mail but it will most likely be expired by then cause my I-94 expires June 30/08...cause i didn't have my receipt number for my AOS yet...i was sending the forms that day...

LONG STORY SHORT...she told me to go back to an office when i had my AOS receipt number...that that would help and they would re-issue me a license with a longer expiration date...got my numbers and i am going to do it on Monday...will let you know how it goes...

The same happened to me. I'm in NYS. IF ONLY I knew that they'd put my I-94 expiration date on my permit, I'd file for AOS much earlier (we filed almost a month after we got marred.) Nobody had to warn me about it, obviously, but I though it'd be good to put somewhere in BIG RED LETTERS (somewhere into the guides on this website for soon-AOS-filers/newly weds) to know that in some states it happens.

I stopped driving May 22 and I'm anxiuosly waiting for my EAD. Can be here any day now, may be even today.... :huh:

EAC = Employment Authorization Card

It's was a bit of a "tag" game for me:

First: get EAC, which counts as "government issued picture ID"

Second: use EAC to get SSN

Third: use EAC and SSN to get NCDL (which expires with EAC until greencard arrives)

Fourth: use NCDL (another form of "govt issued picture ID") to change my name in my Canadian passport from former to married name

But it all works out in the end :)

EAD is the work permit. It is a proof that you are legally in the US in a way, at least that's how the DMV considers it. In NC it is now the law that a driving license will only be issued for the duration of the visa/i-94 validity.

Once you have the EAD card in your hand (it takes about 90 days), you can go back to the DMV and have them issue a DL.

08.2006: Entered with a B-2 visa.

Yup, I have mine valid for 8 years though, just depends on how much you shelled out when you got it. I keep failing my driving test :lol:

The EAC is the same as the EAD...

He was able to get his SSN without the EAD...So, should be able to extend the permit once we receive the EAD..
