Hi :) My husband and I have a question with regards to Evidence of a Bonafide Marriage. These are documents needed to submit aside from Marriage Certificate. I will list them down:

Note: Evidence of a Bonifide Marriage

The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:

1. Documentation showing joint ownership or property; or

2. A lease showing joint tenancy of a common residence; or

3. Documentation showing co-mingling of financialresources; or

4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or

5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or

6. Any other relevant documentation to establish that thereis an ongoing marital union.

*We do not have the documents from 1-4. Our question is about the Affidavits on number 5. Is it ok if we will be sending in an affidavits sworn to or affirmed by third parties from the Philippines and not from USA? Is it ok to get a relative as third party or should it be someone not related to me and my husband? Also in number 6, can we send in supporting documents such as pictures or letters and plane tickets and hotel receipts? I appreciate so much any help you can give us. :thumbs:

Hi, the pictures is very important to show to them, why not open a bank account together if he is here her with you for addional evidence?

1. pictures, with both of you, your family, the wedding

2. invitation card that you have from the wedding

3. the marriage license certificate that u have applied in municipality, just a copy of it

4.joint bank account - showing that u have trust to each other even not so much in savings

much better than number 5, we never have that, if you have then make it additional then

USCIS has yet to be that strict on original I-130 application requirements. Send in copies of anything you have showing a bonafide marriage. Life insurance for one example.

I imagine most hubbys have a policy on their foreign brides! :bonk:

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

When proving relationship the adjudicating officer will expect different information from newlyweds than from couples who have been married for a few years. My son filed the I-130 a month after they registered their marriage at the Amphur in Thailand, and they had nothing in both of their names (he came back to the states three days after). They had no ceremony, so there were no wedding pictures (yet to come). The most powerful evidence he had besides the marriage certificate were probably pictures of our families together and one of her with us in front an of the "The Highest Spot in Thailand" sign. As the Mother of the petitioner, I wrote a narrative of of a couple of pages on how I observed their relationship evolve for over a year and had it notarized. Unique details, and how the person came to know of them, and a plausible true story I think, are important, not "legalese", although you do have to include the identifiers you listed. I basically wrote their love story from my point of view. It was the only affidavit he submitted. I don't see why there would be a problem with affidavits from the Philippines. They also had a couple of things from #6.

They have some accounts in both of their names now, plus phone bills, cards, some emails, etc., so she'll have those to take to the interview. I wouldn't sweat it much for the I-130. Quality is better than quantity. The adjudicator would rather see a couple of very convincing items rather than get snowed with 100 pages (just my opinion).

Hi there my husband and I submitted the AFFIDAVITS from the two witnesses that both signed in our marriage certificate and it worked. Im already in the process of getting my K3 Visa, just had my medical exam yesterday and my interview is on June 25. We didn't show any documents or open a joint account. It should be notarized in the place where you got married and make sure they both have latest CTC (Community Tax Certificate or Cedula) number. Also you can file the form I-130 and 129F simultaneously so it would approved at the same time.

Hi! Me and my Husband don't have all the documents either, since we just got married. SO we've sent one sworn affidavit made by his roommate who is also my friend. Besides pics of the wedding, honeymoon and other pics with him from when I lived in the US.

We also sent copies of his tickets to Brazil and of the document he got at the brazilian border. Also some e-mails, text messages he sent to my email, stuff like that.

So far, no RFE's :yes:
