what name to use

Timeline

My Fiancee is about to get her annulment, and she said something about getting her maiden name back again . My question is , On all the paperwork for the K1 visa that I am ready to send off , what name should I use . The one she is using now or her maiden name?

Also , we have allot of documentation of our meeting together and of our ongoing relationship . Any ideas on how much I should send with application . I do not want to swamp them with proof , but want to make sure I have enough.

Once she's gotten her annulment, I'd be submitting paperwork in her maiden name. There are questions on some forms which ask that you put down every name you've ever used, and you could put her previously married name in those spots.

When submitting your paperwork for a K-1, the only evidence you need submit is proof of having met within the last two years. One or two pictures might suffice, but it's important to send copies of boarding passes, hotel receipts, receipts of things you may have bought there. It's to prove that you two met, period. Evidence of your ongoing relationship doesn't get produced until she has her interview. Don't overload them with evidence that they're going to have to sift through at the beginning. That will come later, and you can provide a ton of stuff at the interview.

Hi Carlawarla - similar situation to Dawes: my fiancee [also from the Philippines] received her annulment earlier this year, and we submitted her I-129 in her maiden name. We've gotten the NOA2, and are now wondering if she absolutely needs to get her passport changed as well prior to the interview at the USE? It is still in her married name, and the woman on the InfoPass service said that though they will actually issue the K-1 in the name listed on her passport so they match, they "advise" us to get it changed prior to the interview.

Anyone have experience / advice for this situation?

Use her current legal name at the time of petition filing. Will that be different than the name she uses today?

I would simply send adequate primary evidence like passport stamps, boarding passes and maybe a picture or two.

Facts are cheap...knowing how to use them is precious...

"Better" is a difficult judgment. Keeping her current name until you're married would mean she doesn't need to change her passport or other documents until after you are married but would need to after the marriage. Depending on the country changing passport names while in the US has varying complications.

Keeping her current name forever is definitely the simplest logistically.

Changing the name before you file the petition would mean she needs to get all that done pretty quickly then either keep that name or go through the whole name change process again.

But you thought all that through already, right?
