Cancel K3 petition and file K1

Can a couple cancel their K3 petition, and get divorced, then file for a K1 petition??

Im serious with this question. I could not find anything on this, only the information of the requirments to file for a K1.

I know Ilya posted a topic, but he was just kidding, but it got me thinking, can it be done???

Why would you do that?

You honestly think it would be faster? Is that why?

they will probably look as to why you did that.. also, it may give them a reason to deny or ask for more INFO.. and the time in-between marriages also can be bad.. I think The K-1 is more riskier too.. but I'm sure you can do it this way... Again, if you marry the same person, they can tell right away too.. =(

to tell you the truth though.. I wouldn't risk it.. that's why I didn't do the fiance visa in the first place.. if I got a "deny" on that, then I would have a strike against the K3 if I did apply for that next.. now I have a reason that I can fight with.. USCIS will always come up with reasons to protect themselves..

No not a way to make it faster, but there would be good reason behind it. And the way USCIS thinks with their rules and regulations, we have already met the regulations to file for a K1 we have met, emails galore, pictures, and etc. Its a bit more complicated of why Im asking, but I do not see that a former married couple could not do this. As long as what ever visa a person files for, they just have to prove a TRUE relationship. Correct? , Yes.

thank you Paris Heart.. and I wish that your journey would be restarted soon and get approved =) you should do some more research on this before you try it though.. it's better to be prepared than sorry later on.. they might put a new rule saying once you do K3, you can't do K1 or something like that.. I sure hope not.. there should be people who ask this question before.. maybe not on here, but elsewhere.. good luck!!

But as everyone knows, I did cancel my petitions with USCIS 2 weeks ago. Now I need to finish this other journey from Hell Im in now, then I will re-start my Long life Journey with my adoring husband once again.

But as everyone knows, I did cancel my petitions with USCIS 2 weeks ago. Now I need to finish this other journey from Hell Im in now, then I will re-start my Long life Journey with my adoring husband once again.

I'm confused. It seems to me you are saying the 'proofs' for a K1 are less than for a K3. While we didn't do K3, from my readings I don't think that's necessarily the case. Ultimately, the bonafides of the relationship have to be proven with any familial connection.

I know it is confusing, and Im NOT saying K1 are less proof required then for a K3 or a CR-1. Both petitions have to have solid proof of a real relationship. I apprechiate everybodys input on this matter, but I will leave it up to USCIS on Friday. After all , they are the ones who will review the petition. Thank you!

Well as soon as you saw each other, you knew that you had made a huge mistake and were meant to be married. So you run off to Las Vegas get married, and apply for AOS.

This is a patently stupid idea unless there is an actual need for it, like the current marriage turned out to be bigamous or not legal in some way.

Since I know at least one couple who were married a billion years, divorced and then remarried, I could see it happening. People do strange things especially when it comes to love.

(they later divorced for the second and final time.)
