hey all vj,

i need some informations about the k3 and IR1.

both i129 and i130 were approved and obviously,they r both being processed at the nvc.!!!!

my qst is: is it possible to process both of them in parallel?

I-129 has been forwarded to the consulate and my wife is supposed to receive the packet 3 within few days,if we work on the I130 with the nvc and if the case is complete before that the consulate schedule her interviw for k3,would they replace i129 with i130 the day of the interview?

and if she has her interview before that the case is complete at the nvc,all what im gonna go thru at the nvc will be useless if she cant attend her interview at the consulate in her country?

i was overseas with my wife when i received the approval,the letter from nvc saying that they forwarded our case to the consulate,the forms and fee bill im supposed to send to the nvc.....i received everything at once!!!lol

so,im kind of a little bit confused about what i can do,ill appreciate any help from u.

06-04-2008:received a letter stating that within a week,our i-129 will be forwarded to the embassy...

06-20-2008:received packet3

06-21-2008:medical

07-14-2008:interview

Yes, if the I-130 catches up and arrives even one day before the K3 interview, she can have an IR1 interview instead. She'll need to make sure her vaccinations are in order. Alternatively, you ignore the I-130 related correspondence from NVC and simply adjust status in the US after using the K3 visa, or stay or go back to interview for an IR1 visa later. The second visa invalidates the first whether used or not.

Facts are cheap...knowing how to use them is precious...

Yes, she can go back to her country and have the interview, then you would not have to Adjust Status. Or, if you get the K3, depending on where the I-130 is in the process, maybe she can stick around for a couple more weeks thill the other interview.

This is the exact thing that I am doing right now. I just recieved the packet 3 for my wife's K3 and we are going to be sending it to the Embassy next week. Also, I am paying all of the fees and sending the paperwork to the NVC for the CR1.

I am still pursuing the K3, just in case something happens at the NVC with her I-130. Then she will still be able to come to the US while things get worked out with the I-130.

My hope is that we will complete the case at the NVC for the I-130 before the K3 interview. If not, i hope it will be done shortly after. But I am prepared that she might have to return to Buenos Aires for the CR1 interview at the Embassy. Because, the CR1 interviews are only done at the Embassy.

Either way, this will get her Green Card and SS sooner than adjusting Status. Also, the cost is $470, as opposed to $1010 for Adjustment of Status.

But if you pursue both routes and ultimately have to return for the interview, it will negate and maybe cost more than going through the NVC, but she will get her GC and SS sooner.

But, with the online payment system and the shortcuts with email, people have been getting through the NVC in about 4 weeks.

So vaccination requirements only apply to the immigrant visa? Or does it apply to both immigrant visa and to non-immigrant visa I-129F?

K visas can wait until after US entry to complete vaccinations but will need to do so before status adjustment.
