We didn't have the current year either, but submitted the previous three years. We got an RFE, asking for the IRS form 4868 (filing extension) for the most current year. So if you don't have your 2007 done, then you should probably send in the 4868.

You will get an RFE for the most recent year's IRS return which is 2007 this is specified by form I-864, if not filed yet then need to attach a copy of extension request.

was the 4868 enough or do you need something from the IRS that the extension was granted. the 4686 just shows you filed for it...

I'll give you the exact wording from the RFE:

"Extensions: If the sponsor requested an extension of the IRS filing deadline to file federal tax returns, submit a copy of IRS Form 4868 Application for Automatic Extension of Time to File US Individual Tax Return or any other request for extension submitted to the IRS along with a copy or IRS-issued transcript of the sponsor's tax return for the previous tax year. Include any and all W-2's, 1099s, and IRS schedules submitted to the IRS with the tax return."

So we called the tax accountant and asked him to fax a copy of said Form 4868 directly to our attorney, who in turn submitted this back to the USCIS with the following note:

"Attached is a copy of Mr. Smith's From 4868 for 2006. Mr Smith's Federal Income Tax return, Forms W-2 and 1099 for 2005 and 2006 were submitted with the original adjustment of status application."

See if you can get your accountant to send you that 4868 form that he/she filed on y'all's behalf (which he better have done.... don't want to raise any question about your hubby's integrity when it comes to paying taxes!! :bonk:
