Have any of you ever heard of having to file a waiver for unauthorized employment with a fasle ss# along with your I-485 packet? We are about to file for AOS for my wife who entered on a K1 visa and when she was here on a B2 visa 4 years ago she worked without authorization using a false ss#. She has been issued a ss# recently which we applied for after our marriage.

My lawyer whom I have used for the I-601 overstay waiver and 10 year ban is telling me she will need a waiver to adjust status and it should be filed along with the I-485. The lawyer is saying fraud was commited buy using a false ss# and that she will be subject to deportation. I just spent 30 months going thru the I-601 waiver process for a k1 visa. Now I have to get another waiver? The employment was not listed on the original G-325A as I understood that unauthorized work was forgiven upon marriage to a US citizen. Now if we list it on the current G-325A will USCIS think we lied before? During the I-601 process she staed that she worked while here on a B-2 visa but it was an answer to a question on another form, not the G325A and it didn't ask where or when. No issue was made of the unauthorized work.

After she left the US in 2004, she received a letter from the SS Administration about a mis-mattched ss#, ie, the name and number didn't match. No replly was made to the SS Admin. and no furhter letters were recieved. No problems arose when she applied for her ss card upon her recent US entry.

Should we wait until USCIS requests a waiver or puts her in removal proceedings or should I follow the lawyers advice and file now? I just feel that they are looking for a problem where none currently exists. I have never heard of this happening to anyone as of yet. Please help.

NEVER wait until things reach the removal proceedings stage. Follow your lawyers advice (it's what he's there for after all).

I have enough experience with lawyers to know that they always don't know what is best. I have searched the internet high and low and cannot find any information about this. I was hoping someone here may have some information about this.

The problem with not having full disclosure up front is that if this is picked up you will surely regret it later on. Your situation is unique and as much as you've mentioned no one on here knows the particulars of your case like you, your spouse and your lawyer. Again, I suggest you follow your legal counsel.
