An RFE is a request for evidence.

You will need to provide them with a letter explaining why you did not file, you cannot email it to them and you will have to wait for them to send you a request for the information now.

Enforceable Affidavits of Support

If the sponsor did not file a tax return, the sponsor must prove that he or she was not required to file. If a sponsor should have filed, the sponsor must file retroactively and provide proof of filing. Note that U.S. citizens generally have an obligation to file a tax return on non-U.S. earnings even if there was no tax liability.

Note: Typical proof that a sponsor was not required to file a tax return for a particular year would consist of

- a written statement from the sponsor, signed under penalty of perjury, attesting to the amount of his or her income for the relevant year and to the fact that a tax return was not required by law.

USCIS adjudicators handling Form I-864 issues should be aware of the income threshold for the requirement of filing a tax return for the last several years, so that an RFE for evidence of the law is not necessary. In particular, the Instruction booklets for each year's Forms 1040, 1040A, and 1040EZ specify the income threshold below which a person is not required to file a return. link

i filed up I-864 for my self and I-184 for my sister which is my co sponsor... we dont live in the same house though.

Ohhh good, so if IF they for some reason can't figure it out they will probably send you an RFE, then you can send them the letter with full explanation and any other forms you feel will help.

Im in a similar situation, I will be using a cosponsor too.

Hi,

The NVC isn't really interested in what you were doing when you were not working (the interviewer might inquire about it, but not NVC).

What they want from you is a statement saying you were not legally required to file a tax return as you had no income for those years.

Something like:

Re: 2005, 2006, 2007 tax returns for principal sponsor <your name>

I was not required to file for the above tax years as I had zero income in each of those years.

Date:

Signed: Your signature

Print your Name

Also, your Sister's income is sufficient, she doesn't need to send in her bank statement. It never hurts to re-read the instructions on the I-864, it contains a lot of information you need.

are you working now? I guess that if your income is enough and can be proved by your employer's letter and pay stubs (plus bank documents), you should be fine..

It is difficult to get a transcript for a tax return that was never filed.

Returns that were filed on or about April 15th are expected to be available around June 30. So it appears to be 2.5 mos. +/-

No im not working yet.... im going back on july 17th 2008 and im going to look for a job... but my concern is i already sent the AOS ....

If I were you, I'd attach a short note indicating your income has been too low or zero during the past X time frame because you've been living with your spouse abroad. As such, you were not required to file a tax return. Please see my sister's I-864 submitted as a qualified sponsor. Of course, file an I-864 of your own.

Maybe you can try faxing your letter with your signature to your sis so she can include it with the forms .. just a thought. A fax is better than no letter at all.. it might avoid the delay by an RFE.
