Hi everyone,

I am in the process of starting my K-1 Visa process for my fiancée in China. I have not yet filed my I-129F yet. I do have a list of documents my fiancée and I need to prepare for the I-129F. But, I am not sure if I need my fiancée’s Birth Certificate and Single Certificate (is that what it is called?) to file with my I-129F. My fiancée has never married before. Did you guys included those two documents with your I-129F? How about those with fiancé(e) in China?

Thank you very much.

Neither is needed with the initial petition. The single certificate shouls be obtained later in the process along with the police report as they and the birth certificate (all from Gong Zheng Chu) will be required at interview.

If you have the translated copy, by all means send it. Many have gotten an RFE for not including it, although technically it is not required. It may all depend on the CO who is working on your case.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

She doesn't have her Birth Certificate or Single Certificate yet. It will take a while for her to get those documents ready. I want to file I-129F ASAP, which is why I am asking if I should wait for those two documents or just file I-129F now without them.

Looks like I don't have to wait.

Thanks

Yes, you can file the I-129F without your fiancee's birth certificate and the single certificate is called in the Philippines as Certificate of Non-Marriage. That will be required upon interview.

Good luck on your journey!
