I-864: No tax returns for 2 out of 3 years?

 Share

Item 25 on form I-864, Federal income tax return information, has a checkbox that says:

"I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy transcript of my Federal tax return for only the most recent tax year."

and then asks me to list the last 3 years and my total income each...

The problem is: I only started working in 2007! And only for about half of it, so my tax return for 2007 was quite low.. (I make twice as much now, and salary is well above the poverty requirement.) The two years before that, I was an unemployed student..

What do I do???

You do not check the box, and provide a copy of your 2007 return (1040/W2/1099) OR a simple IRS transcript.

You may need to provide an explanation why you only filed for 2007 and not 2006 and 2005.

Attach also copies of recent pay-stubs, and employer letter showing that you now make enough to provide support.

Thanks for the advice -- but I am nervous about checking that box that says I *have* filed tax returns.. Because technically, wouldn't that be lying? How should I indicate on the form that I have additional evidence to support my current income? Or will they just figure out on their own from my inclusion of it?

Cover letter, or just make a note next to the check box, and attach a letter to the other financial evidence that you will be attaching to the I-864, or I-864EZ
