I need assistance on Canceling Petition

Some Background Info:

I have been knowing this girl for about 3 years mostly as friends..We have always had an interest but the timing was never right.. Recently, I was in her country for 3 months and we hit it off and spent the entire time together.

During that time we decided to become exclusive and take our relationship to the next step.

I would like to file the K-1 for her but it seems as though I'm getting the run around from the initial petitioner as far as the getting the case number to confirm that it is canceled.

Based on the info I gather from him..He sent the I-129F in October, they acknowledged then asked for more information and he had to respond by a certain time..He said that it was a blue paper. Of this I cannot be certain, I am only reporting what I was told.

So right now I really need to get the case number, I will try to call the Petitioner again tomorrow to see if he "finds" the case number..but Outside of that I am not sure because the SO only has his name but NOT his DOB. I don't know what number can she call to get this number, especially if she doesnt have all the info.

The request for additional evidence (RFE) is on blue paper... They will allow typically 89 days to respond... If no response they will close the file.

It has been in RFE status since May 30.

They said a letter requesting a withdrawal of the case to California from the petitioner.

They said that it takes a month to close after receiving the letter.

So I'm wondering should I just wait it out considering I should wait some time before filing myself or just have that letter sent in.

pretty sure he has to or else just wait out until the expired time but either way by the time you decide to send yours it should be taken care of (with the 6 months waiting)

I can't really rely on him, to get this done. I'm tempted to ask if I can send it on his behalf.

You can't send it on his behalf. The realities are that it's his petition and only he can withdraw it. You could go ahead and file your own petition and include a letter from her indicating she has no intention of benefiting from the earlier petition. It will eventually get sorted out. It's not like you're at this guy's mercy. USCIS staff actually exercise some common sense pretty often.

Her indication she has no intention to benefit from the petition would be grounds for denying the petition.
